Deferral of Ellis Act Ordinance Discussion by City Council - September 2019

Please note that the policy discussion regarding the Ellis Act Ordinance scheduled for the San José City Council meeting on May 7, 2019, has been deferred to September 2019. The deferral will allow the City Council and the public to consider additional related policy items, and have a more comprehensive discussion.

The Ellis Act Ordinance applies to situations in which a landlord or developer plans to demolish rent-controlled apartments and build a new housing development. On February 5, 2019, City Council asked staff to research the effects of "recontrol," which occurs when newly built apartments are subject to rent control because the new apartments replaced previously rent-controlled apartments.
