C-11 Solid waste disposal facility permits are required (9.10.950). C-12 Solid waste enforcement fees are based on weight, volume and/or type of solid waste, commensurate with the cost of the solid waste enforcement program (9.10.960). C-13 Disposal facility operator IWM fees are based on the types or amounts of waste accepted and are used to pay the costs incurred to prepare, adopt, and implement the IWM Plan required under Division 30 of the California Public Resources Code (9.10.970) C-14 The local enforcement agency reviews applications for permit modifications, revisions, and permit reviews as required by the California Public Resources Code; application fees are established by council (9.10.980). C-15 The local enforcement agency reviews closure plans and post closure maintenance plans (9.10.980). C-16 The city, at its sole discretion, enters into collection agreements for residential solid waste collection services (9.10.1000). C-17 Weekly residential solid waste collection service is mandatory regardless of whether the premises are occupied and regardless of whether solid wastes are set out for collection (9.10.1010). C-18 Solid waste, rubbish, recyclables, etc., must be set-out in accordance with the provisions of this part (9.10.1040 to 9.10.1100). C-19 Hours of collection are specified (9.10.1020). Set-outs are not permitted except after noon of the day preceding the scheduled collection to noon of the day immediately following collection (9.10.1100). C-20 The city council sets the schedule of fees for residential solid waste collection (9.10.1200) and source reduction and recycling fees (9.10.1120) C-21 The owner of a residence is responsible for payment; an arrangement with tenants does not relieve the owner of that responsibility (9.10.1200) C-22 The city bills the owner for solid waste collection services and for the source reduction and recycling fee (9.10.1200) C-23 Late charges are imposed on all delinquent bills in the amount established by resolution of the city council (9.10.1210). C-24 Upon confirmation by the city council, the delinquent charges constitute a special assessment against the property, and the director of finance records a lien in the office of the county recorder to secure the special assessment (9.10.1260). C-25 Commercial solid waste collection franchises are required (9.10.1350 to 9.10.1360). C-26 Mixed recyclables collection franchises are required (9.10.1370) C-27 Mandatory minimum levels of solid waste collection at commercial premises are enforced (9.10.1380). C-28 Restrictions on disposal containers (9.10.1390 to 9.10.1420) and hours of collection are enforced (9.10.1430). C-29 Commercial solid waste generators pay source reduction and recycling fee based on type or amt of waste produced; it pays city's costs to prepare, adopt and implement the IWM Plan required by Division 30 of the California Public Resources Code (9.10.1435). C-30 Exceptions are available for small businesses that generate less than 1 cubic yard of solid waste per week and are approved by the director of ESD for inclusion in the city's residential solid waste collection program (9.10.1440). C-31 Restrictions on set-out times, collection hours, and containers for the Central Business District and Transit Mall Zone are enforced (9.10.1500 to 9.10.1520) C-32 The council grants franchises to engage in commercial solid waste collection, transportation, and disposal (9.10.1620). C-33 All franchises granted pursuant to this part are non-exclusive (9.10.1625). C-34 Contracts between grantees and commercial solid waste customers provide for cancellation of the contract upon 30 days notice, provide 30 days notice before renewal, and contracts do not extend beyond the term of the franchise (9.10.1630). C-35 The council may terminate a franchise if the grantee does not comply with the provision of the franchise, fails to keep bonds, insurance, licenses or permits current, or fails to submit timely reports within 15 days after written notice (9.10.1690). C-36 The council adopts commercial solid waste fees; franchise fees are payable monthly to Treasury; late fees may be due (9.10.1710) C-37 Grantees file monthly reports of quantities of commercial solid waste collected, transported and/or disposed of, and if required by the director, include a report of the quantities of commercial solid waste recycled and disposed of (9.10.1720). C-38 The city has inspection authority over grantee accounts and records (9.10.1740). C-39 The council grants franchises to engage in commercial mixed recyclable collection, transportation, and disposal (9.10.1820). C-40 Commercial mixed recyclable collection franchises are non-exclusive and are subject to terms and conditions specified in the franchise agreement (9.10.1830). C-41 Commingling with solid waste during collection or transportation is prohibited (9.10.1835). C-42 The council may terminate a franchise if the grantee does not comply with the provision of the franchise, fails to keep bonds, insurance, licenses or permits current, or fails to submit timely reports within 15 days after written notice (9.10.1890). C-43 Grantees file monthly reports of the quantities of mixed recyclables which are recycled during the month and the quantities of residue disposed of at disposal facilities (9.10.1920). C-44 The city has inspection authority over grantee accounts and records (9.10.1740). C-45 Commercial recycling collection permits are required (9.10.2000) and are issued by the director of ESD (9.10.2010). C-46 The council sets commercial recycling permit application fees (9.10.2020); the Muni Code sets late fees for delinquent reports (9.10.2050). C-47 The permit application must include satisfactory proof of adequate financial resources (9.10.2010). The Municipal Code outlines the procedure for denial of permit applications (9.10.2030) and for appealing a denial (9.10.2040). C-48 Commingling of source separated recyclables with other solid waste is prohibited (9.10.2005). C-49 Permits are issued in accordance with Municipal Code Chapter 9.10, Part 14, requirements on the accumulation, transportation, and disposal of swill are enforced. C-50 IWM reports diversion rates to council that are calculated using the California IWM Board's guidelines; state Solid Waste Management Board auditors periodically verify the calculations. C-51 ESD's public education campaigns are the result of various strategies to reduce waste (e.g. Residential Outreach Committee campaign promoting motor oil recycling, and Property Management Task Force promoting multi-family dwelling recycling). C-52 The city funds the county's mobile Household Hazardous Waste (HHW) program to hold collection events for city residents. C-53 The county HHW program also runs a Small Quantity Generator Program for businesses that generate less than 27 gallons or 220 pounds of hazardous waste per month. The county charges the businesses a cost recovery fee for the service. C-54 The city is working with the county to establish a permanent site to collect materials that the state does not deem hazardous; this will allow the city to provide more residents with HHW services for the same price. C-55 The County is the lead in this area; the City is an active participant in the Santa Clara County Hazardous Materials Advisory Committee that is working to promote pollution prevention, regulatory reform and permit streamlining.
