MINUTES OF THE CITY COUNCIL

SAN JOSE, CALIFORNIA

TUESDAY MAY 4, 1999

 

The Council of the City of San Jose convened in Adjourned Regular Session at 2:05 p.m., for a joint meeting with the Redevelopment Agency in Council Chambers at City Hall.

 

Present: Council Members:            Chavez, Dando, Diquisto, Fiscalini, LeZotte, Matthews, Powers, Shirakawa, Jr., Woody; Gonzales.

Absent: Council Members:            Diaz (excused).

 

ORDERS OF THE DAY

Upon motion by Vice Mayor Fiscalini, seconded by Council Member Powers and unanimously carried, the Orders of the Day and the Amended Agenda were approved. Vote: 10-0-1-0. Absent: Diaz.

 

MERGED AREA

6b            Adoption of resolutions by the City Council and Agency Board authorizing the Executive Director to negotiate and execute:

(1)        The fourth amendment to the agreement with CONCUR, Inc., in the amount of $400,000, for a total contract amount not to exceed $860,000, for facilitation services related to negotiation of issues for the Guadalupe River Flood Control Project, and extending the term of the agreement from April 15 through December 31, 1999; and,

(2)        The second amendment to the Cost Sharing Agreement with the City and Santa Clara Valley Water District to provide for shared funding for the CONCUR amendment and authorizing the City Manager to execute all documents.

Documents Filed: Memorandum from Acting City Manager Debra J. Figone, and Executive Director Frank M. Taylor, dated April 21, 1999, recommending the City Council and the Redevelopment Agency Board adopt said resolutions.

Discussion/Action: William J. Garbett spoke against the proposed action. Upon motion by Council Member Chavez, seconded by Council Member Dando and unanimously carried, Resolution No. 68850, entitled: “Resolution of the Council of the City of San José Authorizing the City Manager to Execute the Second Amendment to the Cost Sharing Agreement Between the City of San José, the Redevelopment Agency of the City of San José, and the Santa Clara Valley Water District, to Provide for Shared Funding for the Fourth Amendment to the Agreement With CONCUR, Inc. for Facilitation Services Related to Negotiation of Issues for the Guadalupe River Flood Control Project”; and Redevelopment Agency Resolution No. 4689 authorizing the negotiation and execution of said amendments with CONCUR, were adopted. Vote: 10-0-1-0. Absent: Diaz.
