The Council of the City of San Jose convened at 7:00 p.m. in Council Chambers at City Hall for the 2000 Annual Review of the General Plan.

2000 ANNUAL REVIEW OF THE GENERAL PLAN

 

Referencing the Agenda for the evening’s meeting, Mayor Gonzales welcomed everyone to the first of two sessions on the 2000 Annual Review of the General Plan. He stated copies of the Agenda along with the public hearing schedule are available at the table by the public entrance to Chambers, and that documents relating to the 2000 Annual Review of the General Plan are available for inspection at the Press Table at the front of Chambers. He stated land use amendments and associated text amendments to the General Plan for Council Districts 1, 3, 5, 6 and 7 will be considered in the order shown on the Agenda, and any changes to the public hearing schedule will be made available to the public. As a point of clarification, he stated the motions made during tonight’s session of the City Council regarding any amendments to the General Plan are considered “tentative”, and at the conclusion of the November 21, 2000 public hearing, final action will be taken by the City Council on the 2000 Annual Review. He outlined the procedure for public testimony during this evening’s hearing, and stated Council Members may ask questions of the speakers, which will not reduce the speaker’s time allowance.

Discussion/Action: Referencing the November 13, 2000 memorandum co-authored by Mayor Gonzales, Council Member Chavez recommended deferral of all General Plan Amendments relating to the Housing Opportunity Study and the update of the Housing Element until the associated Environmental Impact Report has been completed, with direction to the Planning Department to broaden the EIR for the Housing Opportunity Study and the General Plan Housing Element Update to include an alternative that would allow a mixed-use designation for sites currently designated for housing as has been discussed by the Greater Downtown Strategy Task Force, and that the expanded EIR also study increasing the current height limitation for properties located in the downtown frame area. Council Member LeZotte asked Staff to identify the affected parcels and to describe the extent the Environmental Impact Report would be amended to include alternate uses. Director of Planning, Building and Code Enforcement, James R. Derryberry stated the amendments, as discussed by the Greater Downtown Strategy Task Force, are identified in the Housing Opportunity Study and will be incorporated in the completed EIR; however, the only change is to include alternatives in the EIR that would allow mixed-use development for the two parcels directly across from the Arena Green. With respect to items 1 and 2 of the recommendation contained in the memorandum from Mayor Gonzales and Council Member Chavez, he advised Council to not defer the update of the Housing Element, as it is the text component of the General Plan for which an environmental review has been completed and prepared for Council action during the current General Plan review. Conceding to the changes proposed by the Director of Planning, Council Member Chavez recommended approval of the Staff recommendations for deferral. Upon motion by Council Member Chavez, seconded by Vice Mayor Fiscalini and unanimously carried, the recommendations of the Planning Director and the Planning Commission for deferral of amendments to change land use designations to Residential Support for the Core Area (25+ DU/AC) (1) on a 2.1-acre site and (2) on a 4.5-acre site to February 2001 for completion of the Housing Opportunity Study Environmental Impact Report, were tentatively approved with modifications to (a) defer all General Plan Amendments relating to the Housing Opportunity Study until the associated Environmental Impact Report has been completed; (b) direct Planning Department Staff to broaden the Environmental Impact Report for the Housing Opportunity Study to include an alternative that would allow a mixed-used designation for sites currently designated for housing as has been discussed by the Greater Downtown Strategy Task Force; and (c) direct that the expanded Environmental Impact Report also study increasing the current height limitation for properties located in the Downtown Frame Area. Discussion/Action: Linda Callon of Berliner Cohen, representing Union Pacific, spoke in opposition to the Staff and Planning Commission recommendation and asked Council to defer the amendment to February 2001 Annual Review for consideration. Council Member Chavez stated the subject site is located near several major transportation routes and facilities, and the applicant is proposing a workplan and timeline to conduct a land use study of the Coleman Corridor, which will provide data useful in determining the highest and best land use within the Coleman Corridor. Since the results will not be available for several months, she noted the appropriateness of deferring consideration of the General Plan Amendment to February 2001. L. Robinson Associates). CEQA: Negative Declaration. Staff and Planning Commission recommend No Change to the General Plan.

 

Documents Filed: (1) A Petition bearing approximately 25 signatures of residents of the Redwood Estates Mobile Home Park, dated November 7, 2000, requesting Council approve the amendment to allow the owners access to properties directly behind the mobile home park. (2) Letter from Richard Soos, Mobile Home Owner, dated November 13, 2000, encouraging Council to uphold the Planning Commission decision regarding the land use.

 

Discussion/Action: Director of Planning, Building and Code Enforcement, James R. Derryberry, summarized background information on the existing and requested land use designations and characteristics of the 3.9-acre site. He stated the Planning Commission, on a 4-3 vote, agreed to retain the current designation, since changing the General Plan designation would reduce the supply of housing in the park and would be inconsistent with the Goals and Policies of the Communications Hill Planned Community and Specific Plan which support a variety of housing types and densities. He stated the Specific Plan deliberately sought to retain this mobile home park community, and based on Council Policy regarding mobile home parks, Staff is recommending no change to the General Plan. Representing the Goble Family, Ronald Robinson spoke in favor of the amendment; and Oscar Gonzales, President of the Redwood Estates Mobile Home Park Association, submitted a petition signed by the residents requesting approval of the amendment. Property owner Richard Soos requested Council uphold the Planning Commission decision. Pointing out the merits and positive results anticipated by the proposed change, Council Member Shirakawa, Jr. stated the applicant has met with community members and agreed to several amenities which will result in relocating residents in the amendment area to vacancies elsewhere in the mobile home park, providing ownership to newly relocated tenants, fixing curbs and gutters, and providing improvements to the playground; additionally, the designation is intended to facilitate redevelopment of the property along realigned Goble Lane for industrial and commercial uses, including access to businesses located directly behind the mobile home park. He recommended Council deny the Staff and Planning Commission recommendation for No Change to the General Plan, and approve the General Plan Amendment and urge property owners to follow through with the relocation of tenants, implementing improvements and other provisions agreed upon during community meetings with the residents. Noting opposition to the recommendation to amend the General Plan allowing the change, Council Member LeZotte stated the vacancies, deterioration, and undesirable conditions of the mobile home park have occurred by design to deliberately phase out the mobile home park. Upon motion by Council Member Shirakawa, Jr., seconded by Council Member Powers and carried, the Planning Director and the Planning Commission recommendation of No Change to the General Plan was not approved; and the proposed General Plan Amendment to Change the Land Use designation to Combined Industrial/Commercial on a 3.9-acre site was tentatively approved with the recommendation that access be allowed to the industrial property directly behind the mobile home park, that the mobile home owners provide relocation for mobile home park tenants, and make improvements and upgrades to the mobile home park as agreed to during the community meeting. GP00-07-04:  General Plan Amendment to change the Land Use/Transportation Diagram designation for the property located on the east side of Roberts Avenue, approximately 880 feet south of Story Road, from Medium Low Density Residential (8.0 DU/AC) to Medium Density Residential (8-16 DU/AC) on a 2.0-acre site (Greater Bay Construction). CEQA: Negative Declaration. Staff and Planning Commission recommend approval for a 12.5-acre site.

 

Discussion/Action: Upon motion by Council Member Shirakawa, Jr., seconded by Council Member Diquisto and unanimously carried, the Planning Director and the Planning Commission recommendation to change the land use designation to Medium Density Residential (8-16 DU/AC) for a 12.5-acre site was tentatively approved.
