The Council of the City of San José convened in Adjourned Regular Session at 7:20 p.m. in Council Chambers at City Hall, to consider amendments to the San José 2020 General Plan.

INTRODUCTION

   

Mayor Gonzales welcomed everyone to the first of two evening sessions on the Fall 2001 General Plan Amendments; the second City Council public hearing is scheduled for November 20, 2001 at 7:00 p.m. in Council Chambers. He stated any motion made by the City Council during tonight’s hearing related to the Amendments to the General Plan must be construed as tentative, and that during the November 20, 2001 Public Hearing the City Council will address the need to reconsider any of the tentative votes, and take final action on the Fall 2001 General Plan Amendments. He urged all individuals having questions regarding the reconsideration process to consult City Staff. With regard to the procedures for the evening’s public testimony, he reviewed the process and time limits for presentations by City Staff, presentations and rebuttal by applicants, and pointed out the two-minute time limit for individuals to address Council on any of the amendments. He pointed out the availability of Council Agendas, which have been placed on the table at the public entrance to Chambers, and the location of the binder containing the General Plan Amendment and staff reports to the amendments for public perusal.

   

CONSENT CALENDAR

   

Upon motion by Vice Mayor Shirakawa, Jr., seconded by Council Member Cortese and unanimously carried, the Consent Calendar was approved and the below listed actions taken as indicated. Vote: 10-0-1-0. Absent: Dando.

   

1.1       General Plan Land Use and Text Amendment change for a 2.7-acre site on the northeast corner of Highway 87 and Alma Avenue:

Discussion/Action: The following individuals addressed Council in opposition to the amendments: Helene Orosco, Anastasha Russell, and Wendy Biliedholm, representing Tamien Neighborhood Association; and Robert Kindlund. On behalf of the applicant, Swenson Builders, Eric Schoennauer spoke in support of the amendment. The recommendation of the Planning Commission and the Director of Planning, Building and Code Enforcement for approval of an amendment to change the Land Use/Transportation Diagram designation to Mixed use (25-150 DU/AC) for 2.7 acres, and to amend the Tamien Station Area Specific plan to increase residential densities up to 150 DU/AC in the Mixed Use designation and to allow maximum building heights of 120 feet, was tentatively approved. Discussion/Action: Mayor Gonzales opened the public hearings on the General Plan Land Use and Text Amendment changes for GP 01-06-05, GP 01-T-14, GP 01-06-06, and GP 01-T-15. Representing applicant Silicon Valley Advisors, Timothy R. Nieuwsma stated portions of the site are located within or adjacent to a designated transit corridor, and that during the public outreach process, the communities voiced two major concerns – the absence of a cap on the number of units that could be built, and the possibility the San Carlos Light Rail Line would not be built and increased vehicular traffic would create problems in the area. He stated the applicant offered a compromise, based on community input, that would cap the number of units for possible development on the property – 25-50-unit designation to be allowed under high-density residential. He stated the 12-25 DU/AC as recommended by Staff would allow for very low-density development of this prime infill location, and is deemed inappropriate by the applicant for an area presently designated for intensification use. He requested Council defer the General Plan Amendments to 2002 General Plan Hearings, when the issue relevant to the construction of the San Carlos Light Rail Line and City Policy on Transit Corridor Development can be clarified. He stated the deferral would also allow the applicant to work with the Shasta Hanchett Neighborhood Group to define a more specific development plan that would address some of the community concerns. Addressing Council on both items, Michelle McGurk, Shasta-Hanchett Park Neighborhood Association asked Council to not defer the items but to approve the mixed-use development with 12-25 DU/AC to the site; and Shiloh Ballard, Silicon Valley Manufacturing Group, and Benn Eifert, Greenbelt Alliance, supported the deferral to 2002 General Plan Hearings. Council Member Yeager stated the medium density is insufficient and the high density 25-50 DU/AC is exceedingly intense; therefore the 12-25 DU/AC with mixed-use overlay is appropriate, as recommended by the Planning Staff and the Planning Commission. Discussion/Action: Mayor Gonzales opened the public hearing on the General Plan and associated Text Amendment changes for GP 01-T-28 and GP 01-08-02. Council Member Cortesé stated the applicant has worked to alleviate, address and amend the issue the Planning Department and community have expressed covering four specific areas of concern. He discussed the issues of neighborhood interface, the potential for wider lots closer to the southerly estate lots, and the issue of protecting the ridgeline, and recommended Council approve a modification to the applicant’s amendment to change the General Plan Land Use designation. Representing the applicant, Tom Armstrong, Vice President of HMH, Inc. spoke in support of the amendment. Upon motion by Council Member Cortesé, seconded by Vice Mayor Shirakawa, Jr. and unanimously carried, the public hearing was closed; neither the Staff nor Planning Commission recommendation was approved; the General Plan Amendment request modified to change the Land Use/Transportation Diagram designation on 5.6 acres of Very Low Density Residential (3 DU/AC), 15 acres of Rural Residential (0.2 DU/AC), and 8.9 acres of Private Open Space on the ridge areas generally above an elevation of 340 feet was tentatively approved.
