MINUTES OF THE CITY COUNCIL

 

 

SAN JOSÉ, CALIFORNIA                                                                TUESDAY, MAY 15, 2001

 

The Council of the City of San Jose reconvened at 7:20 p.m. to consider an amendment to the 2020 General Plan, Council Chambers, City Hall.

 

Present: Council Members:          Campos, Cortesé, Dando, Diquisto, LeZotte, Reed, Shirakawa Jr., Williams, Yeager; Gonzales

Absent: Council Members:           Chavez (excused).

 

2.1       PUBLIC HEARING ON GENERAL PLAN AMENDMENT request to change the Land Use/Transportation Diagram designation from Transit Corridor Residential (20+ DU/AC) to General Commercial, on 2.7 acres located at the southeast corner of Southwest Expressway and Fruitdale Avenue. CEQA: Fruitdale Station EIR (Planning Commission Resolution No. 01-155). CEQA Resolution No. 70356.  Director of Planning, Building and Code Enforcement and Planning Commission recommend approval (7-0-0).

Documents Filed: (1) Memorandum from Planning Commission Secretary James R. Derryberry, dated May 10, 2001, stating the Planning Commission recommended to the City Council approval of Staff’s recommendation for General Plan amendment GP 00-06-05. (2) Supplemental memorandum from Planning Commission Secretary James R. Derryberry, dated May 4, 2001, transmitting the PB&CE Staff report requesting General Plan amendment to General Commercial on 2.7 acres of the subject location. (3) Public Hearing Notice to consider a proposed General Plan Amendment, dated April 20, 2001, and Proof of Publication of the Notice of Public Hearing executed on April 27, 2001, submitted by the City Clerk. 

 

Discussion/Action: Mayor Gonzales opened the public hearing on the General Plan Amendment request to change designation on the subject property. There was no discussion from the Floor; however, Council Member Yeager recommended approval of the General Plan change and read the following Statement of Overriding Considerations: “The Final Environmental Impact Report for this General Plan Amendment identified project impacts, visual impacts, long-term traffic impacts at five screenline intersections and near-term traffic impacts on two freeway segments as well as cumulative long-term traffic impacts all as significant and unavoidable; however, approval of this General Plan Amendment will provide office space that could generate up to 800 jobs in this area; this would foster a better jobs/housing balance in increased tax revenues in the City of San José in accordance with the goals of the City’s economic development major strategy. The General Plan Amendment also would encourage a reduction in vehicular trips by facilitating office uses in close proximity to planned public transit and near to residential development. Approval of this General Plan Amendment also facilitates infill development on a currently underutilized site consistent with the City’s goals for increased infill development. All of these benefits outweigh the significant unavoidable environmental risks and impacts identified in the Final Environmental Impact Report for this General Plan Amendment”. Upon motion by Council Member Yeager, seconded by Vice Mayor Shirakawa, Jr. and unanimously carried, the public hearing was closed, the recommendation of the Director of Planning and the Planning Commission was approved, and Resolution No. 70356, entitled: “A Resolution of the Council of the City of San José Making Certain Findings Concerning the Fruitdale Office General Plan Amendment (GP 00-06-05) Project for Which an Environmental Impact Report Has Been Prepared, Adopting a Mitigation Monitoring and Reporting Program, Making Findings Concerning Mitigation Measures and Alternatives and Adopting a Statement of Overriding Considerations in Accordance With the California Environmental Quality Act”; and Resolution No. 70356.1, entitled: “A Resolution of the Council of the City of San José Adopting, Pursuant to Title 18 of the San José Municipal Code, An Amendment to the San José 2020 General Plan, San José, California”, were adopted. Vote: 10-0-1-0. Absent: Chavez.
