MINUTES OF THE JOINT SAN JOSÉ CITY COUNCIL

AND REDEVELOPMENT AGENCY BOARD

 

SAN JOSE, CALIFORNIA                                                                 TUESDAY, JUNE 26, 2001

 

The Council of the City of San Jose convened at 2.01 p.m. to hear Item 7.1 in Joint Session with the San José Redevelopment Agency Board.

 

            Present:         Council Members -  Campos, Chavez, Cortese, Dando, Diquisto, LeZotte, Reed, Shirakawa, Jr., Williams, Yeager; Gonzales.

 

            Absent:          Council Members -  None.

 

JOINT REDEVELOPMENT AGENCY/CITY COUNCIL ITEM

 

7.1       Approval of a lease with The Comedy Club of San José, LLC, for an Improv comedy club at 62-64 South Second Street in the Jose Theatre.

              (a)      Adoption of a resolution by the City Council accepting the summary of costs and findings of the Summary 33433 Report and the Estimated Reuse Valuation for the lease of approximately 14,000 square feet at 62-64 South Second Street to Comedy Club of San José, LLC, making certain findings, and approving the lease; and,

              (b)      Approval of a lease with the Comedy Club of San José, LLC, for the property located at the 62-53 South Second Street, for a ten year term and two automatic options for an additional ten years; and,

              (c)      Adoption of a resolution by the Agency Board approving a budget adjustment of $200,000 to the Agency’s Adopted FY 2001-2001 Capital Budget; Century Center: Jose Theatre RFQ/Facility Improvements and Leasing line item.

               Documents filed: (1) Memoranda from Redevelopment Agency Executive Director Susan F. Shick, dated June 12, 2001, providing preliminary information; dated June 26, 2001, recommending adoption of said City and Agency resolution; and Supplemental memorandum, dated June 26, 2001, providing additional financial datum. (2) Memorandum from Associate Counsel Katherine Karasz, dated June 26, 2001, advising that Tony Baldino, representing The Comedy Club of San José, has agreed to changes to the lease to provide for the City and non-profit organizations’ ability to use The Jose Theater.

 

            Discussion/Action: William J. Garbett spoke in opposition to the proposal. Upon motion by Council Member Chavez, seconded by Vice Mayor Shirakawa, Jr., and unanimously carried, Resolution No. 70460, entitled: “Resolution of the Council of the City of San José Accepting the Summary of Costs and Findings of the Summary 33433 Report and the Estimated Reuse Valuation Pursuant to the California Health and Safety Code Section 33433 for the Lease of Approximately 14,000 Square Feet at 62-64 South Second Street to Comedy Club of San José, LLC, Making Certain Findings and Approving the Lease”; and Redevelopment Agency Resolution No. 5195, were adopted. Vote: 11-0-0-0.

 

OPEN FORUM

 

            Jesus Orozco, Billy Wang, Rudy Belluomini and Tony Tran voiced opposition to the Exclusive Negotiations Agreement with Black Hunt for redevelopment of the Tropicana Shopping Center.

 

ADJOURNMENT

 

            The San José City Council was adjourned at 2:23 p.m.
