The
Council of the City of San José convened in adjourned regular session at 3:35 p.m. in City Council Chambers at City Hall for a
joint meeting with the Redevelopment Agency Board.
Present: Council Members - Campos, Chavez, Chirco, Cortese, Dando, Gregory, LeZotte, Reed, Williams, Yeager; Gonzales
Absent: Council Members - None
7.1 (a) Approval of Cooperation Agreement between the City and the Agency authorizing the City Manager and Executive Director to negotiate, execute, accept and record all necessary documents required to convey the property interests and implement the actions described in the Agreement; and,
(b) Adoption of resolutions by the City Council and Agency Board authorizing the City Manager and Executive Director to negotiate and execute reciprocal easement agreements with other property owners regarding access easements, and the use and maintenance of common areas and other shared interest in the property consistent with the terms outlined in the approved Disposition and Development Agreement with CIM Group for the development of mixed-use infill projects in the Downtown Core.
Documents Filed: Memorandum from City Manager Borgsdorf and Redevelopment Executive Director Susan Shick, dated May 13, 2003, recommending that the City Council and Redevelopment Agency Board approve a Cooperation Agreement between the City and Agency and adopt said resolution authorizing the City Manager and Executive Director to take certain actions pertaining to the Disposition and Development Agreement with the CIM Group for the development of the mixed-use infill project in the downtown core.
Discussion/Action: Council Member Chavez inquired about the pedestrian easement on the southern boundary of the property, and suggested Staff make sure as the development moves forward that the easements both for pedestrians and existing businesses come in the form of a map to be able to watch how the project develops, and to let them know they still have access to their property. Upon motion by Vice Mayor Dando, seconded by Council Member Chavez, and unanimously carried, the said Cooperation Agreement was approved, and Resolution No. 71554, entitled: “A Resolution of the Council of the City of San José Authorizing the City Manager to Negotiate and Execute Reciprocal Easement Agreements with Other Property Owners Regarding Access Easements, and the Use and Maintenance of Common Areas and Other Shared Interests in the Property Consistent with the Terms Outlined in the Approved Disposition and Development Agreement with CIM Group for the Development of Mixed-Use Infill Projects in the Downtown Core”, Redevelopment Agency Resolution No. 5404, were adopted, with Staff directed to ensure that easements for pedestrians and customers come back in the form of a map as development of the project moves forward. Vote: 10-0-1-0. Absent: Campos.
ADJOURNMENT
The Council of the City of San José and the Redevelopment Agency Board adjourned the Joint Redevelopment Agency Council Meeting at 3:53 p.m.
