REASON FOR ADDENDUM

 

City Council approval is requested to reject all bids for this project so that it can be re-advertised and re-bid prior to the end of this fiscal year.

 

RECOMMENDATION

 

Approval to reject all bids for the West San Carlos Sidewalk Replacement Project, and authorization for the Director of Public Works to re-advertise and re-bid the project.  CEQA:  Resolution No. 62614.

 

BACKGROUND

 

The City of San José Redevelopment Agency has requested the Department of Public Works to replace sub-standard and deteriorated sections of  the existing sidewalk and to install sections of a new sidewalk along Stevens Creek/West San Carlos Street between State Highway 880 and Meyellen Avenue (map attached).  The scope of the project includes demolition of asphalt and concrete, installation of new concrete sidewalks, wheel chair ramps, curb and gutters, driveways, and associated electrical work.

During the bidding process, the City sent an addendum via facsimile to the builder’s exchanges and all listed contractors that had purchased the bid package for the project.  Because of a facsimile transmission error, one of the listed contractors did not receive the addendum prior to the May 17, 2001, bid opening date.  The contractor that did not receive the addendum submitted a protest after the bid opening.

 

Council always has discretion to reject all bids and to re-advertise the project.  Because the addendum was inadvertently not distributed to all listed contractors, staff believes that the fairest course of action is to reject all bids and to immediately re-advertise the project.  Subject to Council approval of this recommendation to reject all bids, the bid opening for the re-bid project is scheduled for June 14, 2001.

 

PUBLIC OUTREACH

 

This proposed project was listed on the City’s Internet bid line and advertised in the San José Mercury News and San José Post Record.  Bid packages for all Department of Public Works construction projects are routinely provided to a standard list of various contractor organizations, builder’s exchanges and disadvantaged business organizations, including United Minority Business Enterprises and the San José Minority Business Development Center.

 

COORDINATION

 

This proposed project has been coordinated with the San José Redevelopment Agency, Department of Transportation, and the Offices of the City Attorney, Risk Manager and Equality Assurance.
