Subject:  SANTANA ROW REDEVELOPMENT WIDENING OF MOORPARK AVENUE AND WINCHESTER BOULEVARD

RECOMMENDATION

 

Adoption of a resolution approving an agreement with Richard V. Orlandi and Margaret Orlandi, trustees, for the acquisition of 0.05 acres of real property located at the southwest corner of the intersection of Moorpark Avenue and Winchester Boulevard in the amount of $200,000, and authorization for the Director of Public Works to execute the necessary documents to complete the transaction.  CEQA:  Resolution No. 68210.

 

BACKGROUND

 

On June 30, 1998, __________ 1999 the City Council adopted Resolution Ordinance 25627 __________authorizing  the Santana Row Project in order to redevelop the former Town and Country Village complex (map attached). The Santana Row project proposes construction of calls for an increase of shopping area from 285,000 to 600,000680,000 square feet of retail space, adding 1,2001201  residential dwelling units and a two 100-room limited service hotels404-room hotel.  The Santana Row project traffic report, dated December 1997, A site traffic analysis of the impact of the project on traffic conditions dated 11 December 1997, was conducted by D. J. Powers & Assoc. The study evaluated the impact of the project traffic on 21 signalized intersections, 16 directional freeway segments and 10 freeway interchange ramps, following guidelines set forth by the City of San José and the Santa Clara County Congestion Management Program.

 

The Draft Environmental Impact Report for the project recommended several mitigation measures, most of which can be accommodated within the existing right-of-way of the intersections, with the exception of a dedicated right-turn lane for the east-bound the intersection of Moorpark Avenue and Avenue traffic to merge into south-bound traffic on Winchester Boulevard.

 

Acquisition of the required 0.05 acres of land for $ 200,000 was negotiated between staff and the property owners based on an Offer of Just Compensation and a determination by Real Estate staff that the purchase price represents fair market value for the property.arrived at after appraisal of subject  property.

 

ANALYSIS

 

The traffic analysis determined that the project willwould exert a have significant traffic impact on traffic at the intersection of Moorpark Avenue and Winchester Boulevard.  Mitigation measures are required at this intersection by the Santana Row project to comply with the City of San José Transportation Policy requirements.  which is not acceptable under the City of San José Standards.

 

Approval of the Agreement for the Acquisition of Real Property requested herein will enable the City of San José to implement the recommended traffic congestion mitigation measures by providing the additional right-of-way necessary to accommodate a dedicated right-turn traffic lane at the southwest corner of at the intersection of Moorpark Avenue and Winchester Boulevard.

 

PUBLIC OUTREACH

 

The property owner was notified and attended several public meetings about this project. The property owner received notice of intent to appraise the property and accompanied the appraiser during the original appraisal and its subsequent update.

 

COORDINATION

 

Preparation of this project has been coordinated with the Departments of Transportation and Environmental Services and the Office of the City Attorney.

 

COST IMPLICATION

 

The City will be reimbursed for the acquisition cost of the required land by the developer of the Santana Row Project in accordance with the already-executed agreements for the project. The City costs are limited to staff cost, which are included in the Capital Budget? (The developer is reimbursing us for our cost).

A Draft Environmental Impact Report was adopted by City Council Resolution 68210 on
