SUBJECT: APPROVAL OF A FIRST AMENDMENT TO THE AGENCY AGREEMENT WITH THE COUNTY OF SANTA CLARA FOR THE COUNTYWIDE HOUSEHOLD HAZARDOUS WASTE COLLECTION PROGRAM

RECOMMENDATION
Approval
of a first amendment to the agency agreement with the County of Santa Clara for
the countywide household hazardous waste collection program to update the
Emergency Collection Plan, provide the program event schedule for FY 2001-02,,
and to provide
greater operational detail, at no cost to the City.
The City Council approved the current agency agreement with the County of Santa Clara for the countywide household hazardous waste (HHW) collection program on June 20, 2000. This countywide program has provided San Jose residents with a safe means of disposing of HHW since December 1991. Under this program, residents can dispose of unwanted household products such as paints, solvents, cleaning products, aerosols, motor oil, antifreeze, and car batteries in a safe and convenient manner.
The program is funded through a countywide $1.50 per ton fee assessed on all waste disposed at landfills and transfer stations in the County. This funding is allocated among participating jurisdictions based on the total household count and total waste generated within each jurisdiction. Based on this funding, service is provided to 3% of all San Jose households.
ANALYSIS
This first amendment will provide specificity and clarification of existing language in the agreement with the County. The amendment will provide for the following:
· Add ammunition to the list of waste not accepted.
· Add language that will facilitate budget augmentations to increase service in fiscal years 2002-2003 and 2003-2004, at the City’s sole discretion.
· Update information for the HHW Emergency Collection Plan.
· Update the drop-off service schedule for FY2001-02.
The amendment was prepared by the Santa Clara County Department of Environmental Health and has been submitted to participating cities for approval. The Director of Environmental Health has authority to approve the agreements for the County before the end of FY 2000-01.

COST IMPLICATIONS
There are no additional costs associated with this amendment. The program is funded through a countywide $1.50 per ton fee assessed on all waste disposed at landfills and transfer stations in the County.
