Subject:     DONATION OF BOMB VAN

 

 

RECOMMENDATION

 

Adoption of a resolution authorizing the Director of General Services to execute all documents necessary for the donation of one surplus Police bomb van with a total estimated value of $1,700 to the City of Mexicali, Mexico.

 

BACKGROUND

 

The San Jose Municipal Code, Section 4.16 governs the donation of surplus property.  The General Services Department/Fleet Management Division deems a vehicle surplus only when it has served its useful life and is no longer economically feasible to repair.  The General Services/Purchasing Division generally sends surplus vehicles to be sold through auction companies, or sells them through a sealed bid process.  Under the Code, other governmental agencies may request a donation or purchase the vehicle before they go to auction.

 

ANALYSIS

 

SJMC Section 4.16.250 states that the City Council may donate property valued at more than $1,500 to a public or governmental body or agency, volunteer fire department, or nonprofit corporation.  Donations have periodically been made to other cities, counties, countries and non-profit organizations where serious budget problems exist.  The Director of General Services is authorized by the same section to make such donations up to $1,500.

 

The City has been requested to donate the following unit to the City of Mexicali, Mexico:

The San Jose Police Department is strongly encouraging the donation of this vehicle which will result in enhanced public safety in this city.

 

PUBLIC OUTREACH

 

Public outreach is not applicable to the proposed Council action.

 

COORDINATION

 

This memorandum has been coordinated with the City’s Attorney’s Office and the Police Department.

 

COST IMPLICATIONS

 

The Department of General Services estimates the current value of this vehicle to be $1,700.  Council approval of this donation will mean the loss of that potential revenue.
