RECOMMENDATION

 

Approval of a one-year lease agreement with Kinco Mercado Real, LLC for 3,420 square feet of office space on the ground floor of a building located at 2065 Martin Avenue, at a rental rate of $12,175.60 per month for the animal control dispatch facility.

 

BACKGROUND

 

Commencing July 1, 2001, the City of San José will be providing animal control services, assuming the responsibility for services currently provided by the Humane Society of Santa Clara County.  In order to accommodate their new responsibilities, the City is constructing an animal shelter and office facility on Monterey Road in San José.  This new facility is scheduled for completion in May of 2002.  In the interim, the City will take over the existing animal control dispatch facility operated by the Humane Society at 2065 Martin Avenue, while contracting with that organization for the housing of impounded animals.

 

ANALYSIS

 

At the request of the City Manager, Public Works Real Estate staff negotiated a new one-year lease for 3,420 square feet of office space on the ground floor of 2065 Martin Avenue at a rental rate of $12,175.60 per month.  This includes an assessment for the City’s share of water and garbage services.  In addition to the rent, the City will be responsible for providing utilities, maintenance and janitorial services to the leased premises.

 

The Martin Avenue site was selected because it is a pre-existing facility that has already been set up for animal control operations, including telephone and radio dispatch equipment as well as an area suitable for the storage of City vehicles.

 

Because the lease term is limited to a one-year period, it does not contain any cancellation language.

COORDINATION

 

This item has been coordinated with the Office of the City Manager and the Department of Parks, Recreation and Neighborhood Services.  The Office of the City Attorney has reviewed the agreement and approved it as to form.

 

COST IMPLICATION

 

Rent for this agreement is $146,107.20.  In addition to the rent, the City will also be responsible for providing utilities, janitorial and maintenance services to the leased premises at an estimated cost of $22,500.
