SUBJECT: APPROVAL OF A GRANT AGREEMENT BETWEEN THE CITY OF SAN JOSE AND THE TECH MUSEUM OF INNOVATION FOR MISCELLANEOUS PUBLIC IMPROVEMENTS

Adoption of a resolution authorizing the City Manager to negotiate and execute a Grant Agreement with the Tech Museum of Innovation in a total amount not to exceed $115,000 for the purpose of completing miscellaneous public improvements.
BACKGROUND
On December 19, 2000, the City Council and the Redevelopment Agency Board adopted resolutions that:
1. Approved the addition of $300,000 to the Adopted FY 2000-2001 Capital Budget Tech Museum of Innovation project line in the Park Center Redevelopment Area from the Capital Reserve;
2. Amended the FY 2000-2001 Agency appropriations resolution; and
3. Approved an amendment to the Cooperation Agreement between the City and the Agency to provide for the City’s acceptance of the Tech Museum and Agency transfer of $130,000 for miscellaneous public improvements to the Tech Museum of Innovation.
At that time, the Agency and City staff had identified a number of miscellaneous items that the City had anticipated would be completed as part of the Tech Museum of Innovation project. The miscellaneous items included projects that would best be managed directly by the Tech Museum of Innovation including the modification to the boiler system, the installation of a water softener system, repair and/or replacement of interior and exterior signage, and the relamping of Parkside Hall and the Tech Museum of Innovation light fixtures.
The proposed agreement would establish a system to reimburse the Tech Museum of Innovation for improvements. The improvements are subject to approval and inspection by Public Works. Due to the nature of the improvements, public bidding requirements are deemed an idle act, and the Tech Museum of Innovation is permitted to negotiate with the most appropriate firms for the specific improvements.
Construction of the Tech Museum of Innovation was substantially completed in September 1998, and a Temporary Certificate of Occupancy was issued in October 1998. The facility has been under the operational control of the City since November 1998 with the Tech Museum of Innovation as the non-profit operator.
This recommendation has been coordinated with representatives of the Tech Museum of Innovation.
This memorandum has been coordinated with the Department of Public Works, Tech Museum of Innovation staff, the City Attorney’s Office and the Budget Office.
