RECOMMENDATION

 

Adopt a resolution authorizing the City Manager to negotiate and execute an Agreement among the Humane Society of Santa Clara Valley and the cities of San Jose and Milpitas for the provision of animal services with San Jose’s share of the compensation not to exceed $1,875,835, for the period of July 1, 2001 through June 30, 2002.

 

BACKGROUND

 

The cities of San Jose and Milpitas have contracted with the Humane Society of Santa Clara Valley for animal control services (dead animal pickup, field and shelter services) since July 1993 and for animal licensing services since August 1995.  San Jose also previously contracted with the Humane Society for animal code enforcement services.  However, the City has provided these since July 1, 2000.  Effective July 1, 2001, the City of San Jose will assume the field services, and when its new animal shelter is completed in 2002, it will assume all animal services for itself and the City of Milpitas.  This agreement will provide for the Humane Society to continue animal services until the new facility is completed.

 

ANALYSIS

 

The agreement provides for the provision of specific services by the Humane Society, including shelter services and dead animal services.  The shelter services include sheltering of abandoned, impounded, lost or stray domestic animals, quarantine of biting animals, and rabies testing, as well as provision of medical services related to the shelter.  Calls for all other services shall be referred to the City by the Humane Society.

 

This agreement provides that the Humane Society will provide the above services at the fixed cost to the City of San Jose of $893,185, for the period July 1, 2001, through December 31, 2001.  The cities will have the option to contract for services on a month-to-month basis for the period January 1, 2002, through June 30, 2002, at a cost to the City of San Jose of $163,755 per month.  It is the City’s intent to exercise this option for the period from January 1, 2002, until the new animal shelter is completed.  The Humane Society will collect fees, charges and penalties from the public, as established under the City’s Fees and Charges Resolution, in connection with some of the services it provides under this agreement.  These program fees will be paid to the City.

COST IMPLICATIONS

 

Funding for this agreement is in the Proposed 2001-2001 Operating Budget, City-wide Expenses.  Costs for this agreement will be partially offset by revenues collected for the City by the Humane Society.
