SUBJECT:     APPROVAL OF A GRANT AGREEMENT BETWEEN THE CITY OF SAN JOSE AND THE CHILDREN’S DISCOVERY MUSEUM OF SAN JOSE FOR MISCELLANEOUS PUBLIC IMPROVEMENTS

RECOMMENDATION

 

Adoption of a resolution authorizing the City Manager to negotiate and execute a Grant Agreement with the Children’s Discovery Museum of San José in a total amount not to exceed $336,800 for the purpose of completing miscellaneous public improvements.

 

BACKGROUND

 

In the FY 1999-2000 budget of the Redevelopment Agency (RDA), $350,000 was identified to provide capital improvements projects for the Children’s Discovery Museum of San José (CDM).  The funding was identified for the fountain design deficiencies and interactive exhibit installation: security system improvements that may include cameras, locks, lighting, and restricted entry/exit features: and a telephone central routing and storage system.  Of the $350,000 identified in the RDA budget, $200,000 will be applied to the grant to the CDM, with the balance of $150,000 maintained by the RDA to continue the fountain improvement project.  In the FY 2000-01 City budget, an additional $152,000 was identified to provide specifically for the painting of the CDM building, including the preparation of all stucco and building surfaces. 

 

The proposed grant agreement would establish a system to reimburse the CDM organization for managing and coordinating a portion of the improvements needed, specifically the building painting with installation of expansion joints at the base of the building, and security and telephone system upgrades.  It is acknowledged that the CDM has a Board policy to receive a minimum of three (3) bids, which will comply with the City’s requirements for general services and purchases and that contractors selected for any services will be required to meet the City’s provisions regarding payment of prevailing wage.

 

The Department of General Services (GSA) will provide active support in approving the scope of services and inspecting and accepting all phases of the work.  A portion of the funds will be reserved to compensate GSA for the services GSA provides.

 

ANALYSIS

 

Construction of the CDM was substantially completed by June 1990 with the fountain identified as needing attention.  The facility has been under the operational control of the City since August 1997 with the CDM continuing as the non-profit operator.  While funds have been identified in past budgets for these improvements, it has become apparent that due to the uniqueness of the improvements and requirements of the CDM to have the work performed during the closure of the facility in September 2001, with specific parameters that involve CDM scheduling, project management by the CDM is the most appropriate way of accomplishing the work.

 

PUBLIC OUTREACH

 

This recommendation has been coordinated with representatives of the Children’s Discovery Museum of San José.

 

COORDINATION

 

This memorandum has been coordinated with the Department of General Services, the Children’s Discovery Museum, the City Attorney’s Office, the Budget Office, and the Redevelopment Agency.  Risk Management will coordinate insurance requirements for the agreement.

Budget Document:        The amount of $352,000 will be part of an appropriation adjustment agendized concurrently with this item.
