Subject: SAN JOSE POLICE ACTIVITIES LEAGUE AGREEMENT

Adopt a resolution authorizing the City Manager to
negotiate and execute an agreement with the San Jose Police Activities League
(PAL) to design and construct a fitness center facility on the PAL Stadium
property, which is owned by the City.
The term shall commence upon execution of the agreement and expire 36
months after the date of full execution of agreement. The amount is not to exceed $639,000 in funding toward the cost
of design and construction of the fitness center.
BACKGROUND
The
City is the owner of the property located at 680 N. 34th St., San
Jose including the facilities known as the Police Activities League
Stadium. PAL currently operates the
programs at the stadium pursuant to a License Agreement entered into on January
26, 1983 and expiring January 25, 2003.
PAL desires to design and construct a fitness center facility on the
property, to be located between the existing field house, PAL office building,
and bordered to the east by the football/soccer field. The fitness facility would provide a safe
place for neighborhood youth to train in boxing, tae kwon do, weight lifting
and physical fitness. PAL will provide
the design services, materials and labor for the construction on the
property.
In June
1999, Council allocated $300,000 for this project, based on a very preliminary
estimate by the PAL Board of Directors.
Since then a more thorough estimate was developed and in the Mayor’s
Budget Message for 2000-2001, dated June 6, 2000, an additional $339,000 was
funded.
An agreement has been prepared in which the City’s Director
of Parks, Recreation & Neighborhood Services is responsible for overseeing
the City’s parks, including PAL Stadium.
In addition, the City’s Director of Public Works is responsible for
overseeing the construction of public improvements on City property, also
including PAL Stadium.
PAL agrees to design and construct the fitness center on
City property. PAL agrees to pay for
all costs associated with the design and construction of the improvements. All work must be
designed and constructed with City’s standard
specifications as determined by the Director of Public Works. PAL shall submit a schedule of construction
for the approval of the Director of Public Works and also provide insurance and
bonding requirements as requested, prior to the Notice to Proceed being issued.
City shall pay PAL up to $639,000 toward the construction
of the fitness center, including City’s inspection and review fees. The City shall have no other responsibility
for any costs for the construction of the Center.
PUBLIC OUTREACH
The San
Jose Police Activities League is a California non-profit organization and is
also a United Way agency. They have an
active Board of Directors comprised of many people in the community, including
a real estate agent, retired teachers, members of the media, members of the
City Council, and staff members from the San Jose Police Department. Police officers run and coordinate all of
the programs with assistance from volunteer coaches. The program reaches youth ages 5-18 years throughout the City of
San Jose. They provide financial
assistance to youth that cannot afford to participate in their programs. Activities include: Baseball, boxing, football, girls softball,
soccer, martial arts, Jr. Giants program, Law Enforcement Unit, and a Drug
Education Program.
COORDINATION
The
proposed agreement has been coordinated with the City Attorney's Office, the
Department of Public Works, and the San Jose Police Department.
COST IMPLICATIONS
Funds
of up to $639,000 to support his agreement are included in the 2000-01 Adopted
Operating Budget. The first installment
of funds was allocated by City Council in June, 1999 with a subsequent
allocation in June, 2000. The funds
have been rebudgeted to the 2001-02 Operating Year.
