DUTIES : The Small Business Development
Commission was created to study, review and make recommendations to
the City Council and/or Redevelopment Agency Board, City Manager and
the Executive Director of the Agency regarding the following areas:
1) the City's Nondiscrimination/Nonpreferential Treatment Program and
policies; 2) the City's Minority Business Enterprise / Women Business
Enterprise and Disadvantaged Business Enterprise programs and policies
for federally funded projects; 3) the City's progress in meeting its
Nondiscrimination/Nonpreferential Treatment Program objectives, and
4) the City's progress in increasing participation by small businesses
in City contracts. The Commission may also study and submit reports
and perform other functions as requested by the City Council, Redevelopment
Agency Board, the City Manager or Executive Director of the Agency.
RELATIONSHIPS : The Commission acts
in an advisory capacity to the City Council and/or Redevelopment Agency
Board. The City Council and/or the Redevelopment Agency Board are the
final decision-making bodies of the City of San Jose. In addition,
so far as practical, and subject to approval by the City Manager and
Executive Director of the Agency, the services of various City/Agency
departments shall be made available to the Commission to the extent
necessary to enable it to perform its powers, functions and duties.
QUALIFICATIONS : The City shall
conduct outreach for ethnic and gender diversity in the membership
of the Commission, with representation by business persons whose business
interests include work as a general contractor, subcontractor, vendor
or consultant. No less than four members shall be representatives of
chambers of commerce or other business or professional organizations
in the City. All members must be residents of San Jose.
MEETINGS : Commission
meetings are the 2nd Wednesday of the month at 6:00 P.M., City Hall, Room
T1446. On average Commissioners spend 3 hours at the monthly meetings.
In addition, monthly subcommittee meetings last 1-2 hours.
BENEFITS : Members of the Commission
will receive no compensation other than expenses approved by the City
Council.
POLITICAL REFORM ACT : The Conflict
of Interest Section of the Political Reform Act applies to the Small
Business Development Commission; however, Commission members are not
required to file a Statement of Economic Interests.
APPOINTMENT PROCESS : All applications received are
submitted to the Project Diversity Screening Committee for review according
to the needs of the Commission as specified in a Needs Assessment Memo.
Applications will also be forwarded to the City Attorney for a Conflict
of Interest review and thereafter, the applicants will be asked to
appear before the Screening Committee Members for an interview. Following
interviews, the Screening Committee will develop a list of applicants
which will be submitted to the Council Member Liaison to the Commission.
The Liaison will forward the list to the Rules Committee of Council
either with or without a supplemental recommendation. The City Council
makes the final appointment to the Commission based on Rules Committee
recommendations.
ATTENDANCE : Commission members
are expected to attend all meetings. San Jose Municipal Code Section
2.08.060 specifies that a Commission Member who has unexcused absences
from any three consecutive regular meetings, or 20% of the meetings
in a calendar year, is deemed to have resigned.
