SUBJECT:         ADOPTION OF A RESOLUTION TO ACCEPT AN AWARD FOR AN OFFICE OF CRIMINAL JUSTICE PLANNING 2001-02 ANTI-DRUG ABUSE GRANT IN THE AMOUNT OF $142,167 AND ADOPTION OF AMENDMENTS TO THE ANNUAL APPROPRIATION ORDINANCE AND FUNDING SOURCES RESOLUTION IN THE GENERAL FUND TO ESTABLISH A CITYWIDE APPROPRIATION TO THE POLICE DEPARTMENT FOR EXPENSES RELATED TO THE GRANT

RECOMMENDATION

 

It is recommended that the City Council:

 

1.  Adopt a Resolution to accept an Anti-Drug Abuse Grant (ADA) award from the State of California in the amount of $142,167;

 

2.  Adopt amendments to the annual Appropriation Ordinance and Funding Sources Resolution in the General Fund as follows:

 

A.     Establish a Citywide appropriation to the Police Department for the Fiscal Year 2001-02 Anti-Drug Abuse Grant in the amount of $142,167; and

 

B.     Increase the Earned Revenue Estimate in the General Fund for revenue received from the State of California by $142,167.

 

BACKGROUND

 

Methamphetamine use and manufacture continues to be the largest drug problem in Santa Clara County.  There is a clear correlation between drug sales and violence within both urban and rural communities in the county.  Incidents of street crime, gang activity, and violent assaults have also grown.  Clandestine methamphetamine laboratories pose health and safety risks in the neighborhoods where they are located.

 

Since 1997, the OCJP has provided annual anti-drug abuse grants to Santa Clara County and other local law enforcement agencies to address substance abuse issues.  The San Jose Police Department’s Metro Unit has targeted street-level offenders.  The Santa Clara County Special Enforcement Team (SCCSET) has operated as a multi-jurisdictional task force targeting mid-to-major level narcotics dealers, traffickers, and manufacturers.  The Probation Department has provided support by identifying narcotics offenders and monitoring their activity while on probation. 

 

ANALYSIS

 

The current year budget for the ADA project is $738,969.  The Police Department’s portion of that budget totals $142,167.  Based on the budget plan submitted to OCJP, the Santa Clara County District Attorney’s Office (as the implementing agency) will reimburse the Police Department for the following expenses:  up to $58,465 for law enforcement officer overtime; up to $41,702 for one contractual clerical position; up to $42,000 for training sworn personnel and emergency stop equipment for unmarked, under cover police vehicles.

 

PUBLIC OUTREACH

 

The State of California Office of Criminal Justice Planning funds this grant, and the Santa Clara County District Attorney’s Office implements objectives and oversees grant expenditures.

 

COORDINATION

 

This memorandum has been coordinated with the Manager’s Budget Office and the City Attorney’s Office.

 

COST IMPLICATIONS

 

The total cost of the overtime expenses, the clerical position, and the non-personal/equipment expenses will be reimbursed by the grant.  There is no cash match or in-kind match required.
