Chair Dando called the meeting to order at 2:05 p.m.

 

A.        Redevelopment Agency

 

             1.        Review October 14, 2003 Draft Agenda

The Committee recommended approval of the October 14, 2003 Redevelopment Agency agenda.

 

             2.        Add New Items to October 7, 2003 Agenda

There was one change to the October 7, 2003 Redevelopment Agency agenda:

 

       Redevelopment Board Requests

         None.

 

       Executive Director Requests

         a.      Defer Item 5.1 to October 21, 2003:  “Implementation of the Mayor’s budget rebalancing recommendations and proposed FY 2003-04 capital and operating budget adjustments.”

 

       RDA Counsel Requests

                                 None.

 

             3.        Staff Reports Outstanding

           

                        Documents Filed:  Report from Redevelopment Agency Liaison Gary Miskimon, dated September 30, 2003, stating there is one staff report outstanding for the October 7, 2003 Redevelopment Agency meeting.

 

                        Discussion/Action:  The Committee noted and filed the Redevelopment Agency Liaison’s report.

 

 

B.        City Council

 

             1.        Review October 14, 2003 Draft Agenda

The Committee recommended approval of the October 14, 2003 City Council agenda.

             2.        Add New Items to October 7, 2003 Agenda

 

The Committee recommended the following additions to the October 7, 2003 City Council agenda:

 

    Mayor and Councilmember Requests

 

      a.      Present a commendation to Billy DeFrank Center for National Coming Out Day  (Reed/Yeager)

 

    City Manager Requests

 

      a.      Present a proclamation declaring the week of October 5, 2003 as Fire Prevention Week

 

      b.      Accept the reports on the Library Benefit Assessment District and the Library Annual Usage

 

      c.      Approve the proposed schedule, process, and evaluation criteria for the FY 04-05 CDBG Application cycle

C.        Legislative Update

 

            1.         State

 

                        Documents Filed:  None.

 

Discussion/Action:  Betsy Shotwell, Director of Intergovernmental Relations, informed the Committee that the State Legislature passed AB1313 which extends Megan’s Law to 2007.

 

            2.         Federal

 

No report.

F.         Appointments to Boards, Commissions and Committees

 

           There were none.

 

G.        Rules Committee Reviews, Recommendations and Approvals

 

            1.                   California’s Megan’s Law: Recommendations for Improvements

                                   (Council Referral 9/23/03 – Item 3.6)

 

                       Documents Filed:  Memorandum from Thomas R. Wheatley, Acting Chief of Police, dated September 5, 2003, requesting Council approve three recommendations to improve the accuracy and effectiveness of the Megan’s Law Database

 

            Discussion/Action:  Deputy Chief Rob Davis reviewed the Police Department’s recommendations to improve California’s Megan’s Law.  Other officers present to answer questions were Sargeant Ron Elder, Officer James Menard and Lieutenant Scott Cornfield.  It was ascertained that the Police Department’s recommendations would have to be enacted by State legislation. 

 

            In response to Chair Dando’s questions, the officers replied that inaccuracies and difficulties in accessing all of the various databases are the main obstacles facing the San Jose Police Department in its monitoring and enforcement efforts.  Until such time as the databases are improved and more readily available to the general public, Chair Dando (referring to her request from March 2003), again requested that, at a minimum, information on high-risk sex offenders be posted on the City’s web site.

 

            The Committee directed the City Attorney and the Police Department to return to Rules Committee in thirty days with a report regarding the feasibility of placing information about San Jose’s high-risk sex offenders on the City’s web page; the Committee also directed Administration to prepare a letter, signed by the Mayor and Council Members, forwarding to the State Legislature the Police Department’s recommendations to improve Megan’s Law.
