SUBJECT: REPORT ON BIDS AND AWARD OF CONTRACT FOR THE
BRIGADOON PARK PROJECT AND ASSOCIATED APPROPRIATION ORDINANCE AMENDMENTS IN THE
COUNCIL DISTRICT 8 CONSTRUCTION AND CONVEYANCE TAX FUND

It is recommended that the City Council take the following actions:
1. Report on bids and award of contract for the Brigadoon Park Renovation Project to the low bidder, HRB Construction, Inc., in the amount of $526,510 to include the base bid and Add Alternate No. 1, and approval of a contingency in the amount of $50,000. CEQA: Exempt.
2. Adoption of the following Appropriation Ordinance amendments in the Council District 8 Construction and Conveyance Tax Fund:
a. Increase the Brigadoon Park Tot Lots Project by $70,000
b. Decrease the Ending Fund Balance by $70,000
BACKGROUND
Brigadoon Park is located in southeast San José near the intersection of Capitol Expressway and Silver Creek Road. The park site is bordered by Brigadoon Way, Daniel Maloney Drive, and Camperdown Way (map attached).
The park was originally built in 1979 and consists of a tot lot, youth play area, wooden pedestrian bridge, concrete slides, volleyball area, and mounded landscape areas. In March of 2000, an assessment and feasibility study was completed to determine the extent of renovation which could be accomplished with the available funding. As part of the feasibility study, a community meeting was held on March 30, 2000 to gather input on the design features. The existing concrete slides in the park are a unique feature in the City park system, and the community expressed a desire to preserve them if possible. An assessment of the slides concluded that with certain renovations, the slides could be retained.
The base bid scope of work for this proposed project includes installation of a tot and youth play area, renovation of the concrete slides, improvements to the existing bridge, concrete walkways, drainage, irrigation, and planting improvements.
This project was originally bid on April 26, 2001. A protest was submitted by the highest bidder after the bid opening. Staff determined that due to an irregularity in the bid documents, all bids should be rejected. On June 26, 2001, the City Council rejected all bids and authorized the rebidding of the project.
The irregularity in the construction documents has been corrected. Staff has coordinated with the project consultant for an equitable settlement for the cost of re-bidding the project.
In addition to the base bid, there are four Add Alternate items included in the project:

The low bid, submitted by HRB Construction, Inc., in the amount of $526,510 for the base bid and Add Alternate No. 1 is two percent over the Engineer's Estimate. Staff considers this to be an acceptable bid for work involved in the proposed project.
A contingency in the amount of $50,000 is requested for any unforeseen conditions that may arise during construction of this proposed project.
An additional $70,000 is needed to complete the project , including Add Alternate No. 1 and the associated increased contingency and construction inspection. It is recommended that the funding be provided from the Council District 8 Construction and Conveyance Tax Fund.
This proposed project was listed on the City’s Internet bid line and advertised in the San Jose Mercury News and San Jose Post Record. Bid packages for all Department of Public Works construction projects are routinely provided to a standard list of various contractor organizations, builder’s exchanges and disadvantaged business organizations, including United Minority Business Enterprises and the San Jose Minority Business Development Center.
This proposed project was coordinated with the Offices of the City Attorney, Budget, Risk Manager and Equality Assurance; and the Departments of Planning, Building and Code Enforcement, General Services, and Parks, Recreation and Neighborhood Services.
