NPDES PERMIT

INFORMATION

On September 18, 2001, Council authorized submittal of comments on the revised Tentative Order related to the New Development and Redevelopment provisions of the Stormwater NPDES Permit and provided direction for the next round of negotiations.

The Regional Board met with City staff and other Co-permittees on September 28 to discuss the proposed language. Each party presented their interests and there was verbal agreement on certain language changes. The next step is for Regional Board staff to draft a third revised Tentative Order incorporating the new language.

The next steps are as follows:

October 10 Regional Board issues third revised Tentative Order

October 12 Affected City departments meet to prepare draft comments, based on potential impacts

October 15 Staff report will be forwarded to Council with recommendation whether to accept the revised draft permit, depending on draft language

October 16 Council to review staff recommendations and determine appropriate action

October 17 Regional Board public hearing in Oakland to receive testimony and determine appropriate action.

 

We recognize that the timeframe between the completion of the report and the Council meeting is very short, but the schedule is not under our control. Our goal is to provide sufficient analysis to respond appropriately and to preserve the City's legal options for the future given the tight schedule imposed upon us by the regulators.
