PREZONING LOCATED ON THE east side of Wabash Avenue approximately 80 feet northerly of Olive
Street.
The Planning Commission voted 7-0-0 to recommend that the City Council approve the proposed prezoning.
BACKGROUND
On September 10, 2003, the Planning Commission held a public hearing to consider a p from Unincorporated County to the R-1-8 Residential Zoning District to allow residential uses on a 0.13 gross acre site.
The Director of Planning, Building and Code Enforcement recommended approval of the proposed p. The proposed project was considered as a consent calendar item. Staff gave a brief report regarding a letter in opposition to the prezoning and eventual annexation of the property. The letter was received from the Burbank Community Association and stated that individual parcel annexation makes “services for the area divided and not cohesive.” Staff responded that annexation of parcels located in county pockets surrounded by city parcels is the policy of both the county and the city in order to move towards more cohesive service provision. There was no discussion by the Planning Commission. Additionally, no one from the public spoke in favor of or in opposition to the project.
The Planning Commission then closed the public hearing.
A notice of the public hearing was distributed to the owners and tenants of all properties located within 500 feet of the project site.
The environmental impacts of this project were addressed by the Final EIR entitled “San Jose 2020 General Plan EIR,” which was certified on August 16, 1994 by the City of San Jose City Council Resolution Number: 65459.
This project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
