Adopt a resolution to provide five certifications required by the State Resources Agency for grant funding associated with the Coyote Creek Trail/Selma Olinder Park project.
BACKGROUND
On February 18, 2003, Council adopted Resolution No. 71414 approving the submission of a grant application for $425,000 to fund development of the Coyote Creek Trail/Selma Olinder Park project.
Resolution No. 71414 states the following:
1. Authorization for the City Manager to negotiate and execute all necessary documents relating to the grant funding agreement; and
2. Approval of the filing of a grant funding application for the Coyote Creek Trail/Selma Olinder Park project.
The granting agency has requested additional commitments be included. The granting agency seeks to have the following added:
1. Certifies that applicant understands the assurances and certification in the application form;
2. Certifies that applicant has or will have sufficient funds to operate and maintain the project(s); and
3. Certifies that applicant has reviewed and understands the Special and General Provisions contained in the Sample Project Agreement shown in the Procedural Guide.
On July 2, 2003, the Parks, Recreation and Neighborhood Services Department received a letter from the State of California Resources Agency acknowledging the Resolution included in the grant application that addressed two of five required commitments. The letter requested that three additional commitments be added in order to complete the processing of the City’s grant application. The agency requires that the commitments be made in the form of a resolution.
The first commitment is that the applicant understands the assurances and certification in the application form. PRNS staff has reviewed these elements and finds that they can be implemented within the City’s current policies and procedures for the operation of its Capital Improvement Program.
The second commitment requires that the applicant has or will have sufficient funds to operate and maintain the project. Once completed, this project will be added to the City’s list of ongoing maintenance responsibilities that are addressed under its operational services budget.
The third commitment is that the applicant has reviewed and understands the Special and General Provisions provided in the Procedural Guide. PRNS staff have reviewed this language and found it to be acceptable given the City’s current policies and procedures for the operation of its Capital Improvement Program.
The action being requested by this memorandum is administrative in nature. However, significant public outreach has taken place regarding the Coyote Creek Trail/Selma Olinder Park project.
This memorandum has been coordinated with the City Attorney’s Office and the City Manager’s Budget Office.
