Approval
of an agreement with Armand and Joan Kunde, husband and wife, and Al Kunde for
the purchase of a parcel of land, a right of entry and a temporary construction
easement for property abutting the south side of Colleen Drive between
Evangeline Drive and Shadelands Drive in the amount of $245,000, and
authorizating the Director of Public Works to execute the necessary documents
to complete the transaction. CEQA: ND.
The Public Works Department is implementing a capital
improvement project to widen and improve approximately 850 feet of the south
side of Colleen Drive at Blossom Avenue.
This will consist of the widening of the street pavement, installation
of concrete curb, gutter, sidewalk and street lights. A retaining wall approximately 3 feet in height and 350 feet in
length is to be installed at the eastern end of the project. The project entails acquisition of right of
way from one property abutting the south side of Colleen Drive. The new sidewalk will connect with the
existing sidewalks at both ends of the project.
The parcel of
land affected by this purchase abuts the south side of Colleen Drive between
Evangeline Drive and Shadelands Drive and is owned by Armand and Joan Kunde,
husband and wife, and Al Kunde (see attachment A). The adjoining portion of the property to be purchased is
approximately 850 feet long, 10 to 25 feet wide and contains approximately
13,506 square feet. The adjoining portion,
over which the City is acquiring a temporary construction easement, is approximately
850 feet long, 10 feet wide and contains approximately 8,513 square feet. Both portions are quasi-rectangular in
shape. The scope of the work includes
the installation of curb, gutter, sidewalk and roadway improvements.
The City’s offer
of $245,000 is based upon just compensation to the owner in the full amount of
the independently contracted appraisal.

The
$245,000 cost of the acquisition and temporary construction easement is
specified in the purchase agreement. In
addition, there will be escrow and closing costs estimated at $1,722. The total cost is anticipated to be
approximately $246,772.
