SUBJECT: SALE OF CITY-OWNED PROPERTY LOCATED NORTHWESTERLY OF OLD BAYSHORE WEST OF 13TH STREET
1) Adopt a resolution declaring said 871.2 square foot portion of now City-owned land, located Northwesterly of Old Bayshore Highway, adjacent to APN 237-27-064, surplus to the needs of the City; and
2) Authorize its sale to Pavone & Pena LLC (the adjoining property owner) for Two Thousand Five Hundred Dollars ($2,500).
BACKGROUND
Municipal Code Section 4.20.20 permits the City Council to declare City-owned property surplus to the needs of the City and to authorize its direct sale to the adjoining property owner when it finds: 1) that a property is neither needed for, nor adaptable to, municipal purposes; and 2) the public interest would be served thereby. In August 2003, this small portion of excess right-of-way was vacated. As the entire parcel is encumbered with a public service easement the Fair Market Value for the parcel was determined to be Two Thousand Five Hundred Dollars ($2,500).
The parcel is roughly triangular in shape and is located adjacent to APN 237-07-064 which is being developed as a small office complex. The parcel is not developable as the entire property is encumbered with public utility easements and is too small. City staff has determined through an Estimate of Value that the Fair Market Value of the subject parcel is Two Thousand Five Hundred Dollars ($2,500).
Maps illustrating the subject property’s general and specific location are attached as Exhibits A and B.
Public Works staff coordinated Public Outreach during the street vacation process.
This memorandum has been coordinated with the City Attorney’s Office, Public Works Department and the City Manager’s Budget Office.
COST IMPLICATION
This sale of City-owned property is in alignment with the Mayor’s Budget Strategy Expenditure Control Strategy by eliminating a City maintenance obligation and liability. Also, the sale of this City-owned property will increase revenue to the City on a one-time basis. The City’s cost for the sale of the property will consist of staff time to complete the transaction. The buyer has deposited the entire Two Thousand Five Hundred Dollars ($2,500) with the City as compensation for the above referenced property.
