RECOMMENDATION

Adoption of a resolution of intention to vacate a portion of Crucero Drive and reserve a public service easement and setting a public hearing on November 4, 2003 at 1:30 p.m.

CEQA: Exempt, Section 15301, HA62-062.

BACKGROUND

This request to vacate the cul-de-sac portion of Crucero Drive (map attached) is a recommendation of the Santee Neighborhood Revitalization Plan to minimize traffic through the existing apartment complex. The Santee Neighborhood Revitalization Plan was adopted by Council in June 1996.

According to the title report issued by First American Title Company, Ginden-R & B Company, a limited partnership, holds fee title to this portion of Crucero Drive.

ANALYSIS

Staff has determined that this portion of Crucero Drive is not needed as a public street. All concerned utility companies have consented to the street vacation.

The actions required for the vacation are:

October 7, 2003 at 1:30 p.m.: Council considers the adoption of a resolution of intention which:

1. Declares its intention to vacate the subject portion of Crucero Drive.

2. Sets a public hearing November 4, 2003 at 1:30 p.m.

3. Directs the City Clerk to file the vacation map and advertise said public hearing, and

4. Directs the Director of Public Works to post the site with a Notice of Public Hearing.

November 4, 2003 1:30 p.m.: Council conducts a public hearing and considers a resolution of vacation, which vacates the subject portion of Crucero Drive.

PUBLIC OUTREACH

The public was afforded the opportunity to comment on the vacation during the planning process. In addition, the Planning Commission considered and approved this vacation proposal which had given the public another opportunity to provide input and comments.

COORDINATION

The required resolution has been reviewed by the City Attorney’s Office. The vacation has been coordinated with the appropriate public utility companies, and the Planning Commission has approved the vacation.

COST IMPLICATIONS

The Public Works Department collected permit fees in the amount of $1,225 to process the easement vacation.
