SUBJECT:  PDC03-046.  PLANNED DEVELOPMENT PREZONING FROM THE COUNTY TO A(PD) PLANNED DEVELOPMENT ZONING DISTRICT TO ALLOW UP TO 15 SINGLE-FAMILY ATTACHED RESIDENTIAL UNITS ON 1.02 GROSS ACRES LOCATED SOUTHSIDE OF CURTNER AVENUE APPROXIMATELY 630 FEET WESTERLY OF BASCOM AVENUE

 

 

RECOMMENDATION

 

The Planning Commission voted 6-1-0 to recommend that the City Council approve the proposed Prezoning. Commissioner Zito voted against the project.

 

 

BACKGROUND

 

On October 22, 2003, the Planning Commission held a public hearing to consider a Planned Development Prezoning from County to A(PD) Planned Development Zoning District to allow up to 15 single-family attached residential units.

 

The Director of Planning, Building and Code Enforcement recommended approval of the proposed p.  This item was pulled from the consent calendar at the request of Commissioner Zito.

 

The applicant, Que Nader spoke in behalf of the project

 

Commissioner Zito questioned the use of the Discretionary Alternate Use Policy (Two Acre Rule) for this proposal.  Staff indicted that the proposed density of 16.3 DU/AC would provide an appropriate transition between the single-family house and large, higher density apartment complex located on either side of the subject site.  While acknowledging the creative site design, Commissioner Zito still expressed reservations about the language of the Discretionary Alternate Use Policy in that it does not require the developer to include “affordable” units within the project.   The City Attorney indicated that the site is not located in a redevelopment area and therefore the developer has no legal obligation to provide any affordability restrictions.  Commissioner Platten expressed similar general philosophical concerns as Commissioner Zito, however he supported the project.

 

Commissioner Campos expressed concern about the preservation of trees.  Staff indicated that many trees, including the largest existing Monterey Pines are proposed to be preserved.

 

No one from the public spoke in favor or opposition to the project.  The Planning Commission then closed the public hearing. 

 

 

PUBLIC OUTREACH

 

A notice of the public hearing was distributed to the owners and tenants of all properties located within 500 feet of the project site. 

 

 

COORDINATION

 

As standard procedure in the development review process, this project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
