SUBJECT: ADOPTION OF APPROPRIATION
ORDINANCE AND FUNDING SOURCES RESOLUTION AMENDMENTS FOR VARIOUS PROJECTS
SUPPORTED BY THE SAN JOSE REDEVELOPMENT AGENCY AND ADOPTION OF A RESOLUTION
MAKING CERTAIN DETERMINATIONS REGARDING THE EXPENDITURE OF AGENCY FUNDS ON
CERTAIN PUBLIC IMPROVEMENTS.
It is recommended that the City Council take the following actions:
1) Adopt the following Appropriation Ordinance and Funding Sources Resolution amendments in the Multi-Source Housing Fund:
a) Increase the appropriation to the Department of Housing for the SNI Housing Rehab Program project by $2,3000,000.
b) Establish an appropriation to the Department of Housing for the First Time Homebuyer Program Equity Capital (PSM 331) project in the amount of $500,000.
c) Increase the estimate for Earned Revenue by $2,800,000.
2) Adopt the following Appropriation Ordinance and Funding Sources Resolution amendments in the Services for Redevelopment Capital Projects Fund (City-side Redevelopment Fund):
a) Increase the appropriation to the Department of Public Works for the Winchester Boulevard Median Island Improvement project by $1,874,000.
b) Increase the appropriation to the Department of Public Works for the Thirteenth Street Streetscape project by $925,000.
c) Establish an appropriation to the Department of Public Works for the OEA Audit Services (PSM 328) project in the amount of $100,000.
d) Establish an appropriation to the Department of Transportation for the Civic Plaza Demonstration Streetscape (PSM 330) project in the amount of $2,200.
e) Establish an appropriation to the Department of Transportation for the Towers Lane Improvements (PSM 332) project in the amount of $420,000.
f) Establish an appropriation to the Department of Parks, Recreation and Neighborhood Services for the Christmas in the Park (PSM 333) project in the amount of $65,000.
g) Increase the estimate for Earned Revenue by $3,386,200.
3) Adopt a resolution making certain determinations
regarding the related expenditure of the Redevelopment Agency funds on certain
public improvements in connection with the Towers Lane Improvements project, as
more specifically described in the memorandum from the Redevelopment Agency,
dated October 14, 2003, attached hereto.
BACKGROUND
The San José Redevelopment Agency (SJRA) has requested City services in the implementation of Agency projects. These proposed amendments are necessary to account for City-side expenditures on Redevelopment Agency projects.
ANALYSIS
On August 27, 2002, the City
Council and the Redevelopment Agency Board approved the Exterior Grants
Component for the Strong Neighborhoods Home Improvement Program. The Exterior Grants component, to be
administered by the Housing Department, can provide a

maximum $25,000 grant for exterior residential rehabilitation, including paint, roof, fencing, walkways/driveway (hardscape), and landscaping upgrades in the Strong Neighborhoods Redevelopment Project Areas and in certain Strong Neighborhoods Planning Areas. The program is available to property owners (rental or owner-occupied) who have properties occupied by households that do not exceed the median income for the County of Santa Clara. The source of funds for this project will be a transfer from the Redevelopment Agency.
First-Time
Homebuyer Program Equity Capital
On September 16, 2003, the Agency Board approved the Redevelopment Agency’s 2003-2004 Rebalancing Budget providing $500,000 of Agency funds to the City to be used as a contribution to the Neighborhood Housing Services Silicon Valley (NHSSV) for equity capital for the first-time homebuyer program. The program will be administered by the Housing Department. The City shall require NHSSV to use the Agency contribution to provide subsidies or benefits to assist in obtaining housing for persons and households with very low-, low- or moderate-incomes in San José. The City shall monitor the performance of NHSSV with respect to the use of the Agency Contribution, and the City shall administer the Agency contribution as set forth in the Cooperation Agreement for NHSSV funding. The source of funds for this project will be a transfer from the Redevelopment Agency.
Winchester
Boulevard Median Island Improvement
This project provides for the design and construction of new landscaped median islands on Winchester Boulevard from Moorpark Avenue to the San José City limit north of Hamilton Avenue. All work is within the SNI redevelopment area. These improvements will enhance the area for vehicular circulation, encourage new development and private investment, upgrade the area’s appearance, and provide a more attractive entry into the commercial corridor and the surrounding neighborhood. These improvements are one of the priority items listed in the Winchester Boulevard Revitalization Plan. The design phase is complete and the project is ready to go to bid. The additional funding recommended in this memorandum would fund bid, award, and construction management for the project. The source of funds for this project will be a transfer from the Redevelopment Agency.
Thirteenth
Street Streetscape
The Thirteenth Street Streetscape
project includes the construction of replacement sidewalks, curbs and gutters
at select locations, installation of pedestrian scale lighting, street trees,
pedestrian amenities, and landscaped medians on North Thirteenth Street, from

Berryessa. All work is within the SNI redevelopment area. These improvements will enhance the area for pedestrian circulation, encourage new development and private investment, upgrade the area’s appearance, and provide a more attractive entry into the neighborhood. These improvements are one of the priority items listed in the Thirteenth Street Revitalization Plan.
The design for the pedestrian lighting, streets trees and sidewalk replacement on Thirteenth Street is completed, and the project is ready for bid. (The design of the landscaped median island has not yet been completed and construction funding is not included at this time.) The additional funding recommended in this memorandum would fund bid, award, and construction management for the portion of the project that is ready for bid. The source of funds for this project will be a transfer from the Redevelopment Agency.
OEA Audit Services
This project provides reimbursement to the Department of Public Works Office of Labor Compliance for time and materials for labor compliance activities in support of the Agency’s public and private projects as required by Council Policy and the California Labor Code. The source of funds for this project will be a transfer from the Redevelopment Agency.
Civic Plaza
Streetscape Demonstration
This project, located at the Mabury yard, will install recommended street and pedestrian lighting fixtures on a temporary basis to be evaluated by the Department of Transportation (DOT) and the SJRA for permanent use in the downtown area. DOT’s services for this project consist of design review, installation of the streetlights, storage of the streetlights, and evaluation. The source of funds for this project will be a transfer from the Redevelopment Agency.
Towers Lane
Improvements
This project constructs improvements on the section of Towers Lane north of Aborn Road in the West Evergreen neighborhood of the Strong Neighborhoods Initiative Redevelopment Project Area. Presently, this segment of Towers Lane does not have curbs, gutters, sidewalks, lighting, street trees or other features found on typical City streets. The purpose of this project is to construct full street improvements. The scope of work includes the construction of pavement, curb, gutter, sidewalk, driveways, wheelchair ramps, storm and sanitary sewer systems, street lighting and street trees. Land is proposed to be donated from 13 parcels. The project also requires the relocation of a PG&E transmission line. Agency funding in the amount of $420,000 will supplement existing funding for the construction costs only of the project. The source of this supplemental funding will be a transfer from the Redevelopment Agency. The majority of the project funding comes from the Traffic Capital Improvement Program, with additional supplemental funding provided by the Sanitary Sewer Capital Improvement Program.
Christmas in the Park
This project provides services that will enhance the public spaces along the Paseo de San Antonio between Market and Fourth Streets and Fountain Alley during the Winter Holiday season. This will result in furtherance of the implementation of Downtown Redevelopment Plans by establishing an environment in the Downtown that promotes community and economic development and encourages retail growth. The source of funds for this project will be a transfer from the Redevelopment Agency.
