RECOMMENDATION
Report on bids and take appropriate action based on the evaluation of bids for the King Road Widening Phase II Project, and approval of a five percent contingency.

BACKGROUND
King
Road is a north-south arterial street in north San José (map attached). King Road between Berryessa Road and
Commodore Drive is only two lanes wide and does not meet current City standards
for arterial streets.
The
King Road Widening Phase II Project will widen the street to four lanes, eliminate
bottlenecks and better manage traffic demand.
In addition it will provide continuity for pedestrian travel along King
Road. This is the second phase of the
King Road widening project. Phase I of
the project between Mabury Road and McKee Road has been completed.
Construction is
scheduled to begin in January 2004 with completion in July 2004.
ANALYSIS
Originally this project included the replacement of the King Road Bridge over Upper Penitencia Creek which was designed in collaboration with the Santa Clara Water District’s (SCVWD) flood control project. The new bridge required permits from the California Department of Fish and Game (CDFG), Regional Water Quality Control Board (RWQCB), Department of the Army Corps of Engineers (ACOE), and SCVWD. ACOE’s permit was issued on March 12, 2003, and suspended on April 14, 2003 per request of the National Marine Fisheries Service (NMFS). The permit was suspended because ACOE staff did not conduct an Endangered Species Act consultation with NMFS. Currently the resource agencies are reviewing different alternatives for flood control in Upper Penitencia Creek. In September 2003, the NMFS, RWQQB, and CDFG requested the bridge project be delayed until a flood control plan had been selected. These agencies are concerned that the proposed bridge will preclude some options for the flood control project. On September 30, 2003, ACOE revoked the City’s authorization to widen the King Road Bridge pending the Corp’s decision on the flood control project.
Due to this conflict, the King Road Widening Phase II Project has been modified to eliminate the replacement of King Road Bridge. The scope of work includes street and sidewalk improvements, new median islands, landscaping, installation of a soundwall along the east side of King Road, street lights, drainage systems, a new traffic signal at the intersection of King Road and Commodore Drive, and traffic signal modification at the intersection of King and Berryessa Roads. Traffic and pedestrian circulation are the motivating factors for the widening and improvement of King Road.
A supplemental memo will be provided after bids are opened on November 6, 2003.
In November of 2002, during the
environmental review process, City staff circulated notices to the community to
summarize the scope of work and notify them of an opportunity for public to
comment on the improvements.
On November 12, 2003, City staff will
hold a community meeting at Ann Darling Elementary School to provide
information about the planned construction schedule, activities and answer
questions regarding the project.
To solicit contractors, this project was
listed on the City’s Internet Bid Line and advertised in the San José Post Record. Bid packages for all Department of Public Works
construction projects are provided to various contractor organizations and
builder’s exchanges.
COORDINATION
This
project and memo have been coordinated with the Departments of Finance and
Planning, Building and Code Enforcement, the City Attorney’s Office and the
City Manager’s Budget Office.

4. FISCAL IMPACT: This project is consistent with the Council-approved Budget Strategy Economic Recovery section in that it will spur construction spending in our local economy. The project will have a neutral impact on the General Fund.
