SUBJECT:  APPROVAL OF FIRST AMENDMENT TO OPERATIONS AND MAINTENANCE AGREEMENT WITH LOS LAGOS GOLF COURSE, LLC RELATING TO LOS LAGOS GOLF COURSE

 

 

RECOMMENDATION

 

It is recommended that City Council approve the First Amendment to the Operations and Maintenance Agreement between the City of San José and Los Lagos Golf Course, LLC relating to Los Lagos Golf Course which provides a mechanism for the golf course operator to manage additional capital expenditures that are not identified in the facility’s annual capital budget but for which the City has appropriated funds to pay for the expense of the capital expenditure.

 

 

BACKGROUND

 

Los Lagos Golf Course is a City-owned, 18-hole, Par 68, golf course with a lighted driving range.  The facility is located at 2995 Tuers Road in Council District 7.

 

The facility opened to the public on April 1, 2002.  Shortly after the facility’s opening, it became apparent that errant golf balls were leaving the golf course from three of the perimeter holes. 

 

 

ANALYSIS

 

Since the course’s opening in April 2002 modifications have been made to address errant ball issues.  Specifically, the modifications were:

 

·        Fence installation between holes #10 and #1

·        Fence installation, tree plantings, barber pole installation at hole #6

·        Netting installed at hole #17

·        Fence installation, barber pole and trees planted at hole #18

·        Change in turf mowing at #6, #13, #17 and #18 to better align the golfer in the direction of the hole

 

Staff has been advised by San José Conservation Corps (SJCC) administration that errant golf balls have been landing and continue to land in the SJCC yard that lies adjacent to Hole #13 of the golf course. 

 

In the 2003-04 Adopted Operating Budget, City Council approved an appropriation of $123,000 to fund a net of approximately 90’ in height that will run approximately 200 linear feet between the SJCC yard and the golf course paralleling the fence line.

 

Council action will allow the netting project at Hole #13 to be considered an ‘Additional Capital Expenditure’ per the First Amendment being recommended for approval. 

 

The Hole #13 netting project involves the golf course operator’s management of the netting project installation with the City paying, from the established appropriation, the cost of the netting project.  The current project cost estimate is $99,900.  This includes design, materials, installation, a project contingency, a negotiated project management fee to the course operator and the estimated cost for Department of Public Works for design review and inspection of the project.

 

Upon approval of the First Amendment, a letter would be issued to Los Lagos Golf Course, LLC to proceed with the Hole #13 netting project installation.

 

 

PUBLIC OUTREACH

 

Public outreach has included the San Jose Conservation Corps in apprising them of this recommendation to Council for consideration.

 

 

COORDINATION

 

This memorandum has been coordinated with the City Manager’s Office, Budget Office, City Attorney’s Office, and Departments of Public Works and Planning, Building and Code Enforcement.

 

 

COST IMPLICATIONS

 

There are no cost implications associated with the recommended amendment.  Approval will allow the netting project to proceed and result in the expenditure of funds identified for the project.
