SUBJECT:     PDC01-03-042.  PLANNED DEVELOPMENT REZONING LOCATED AT THE WEST SIDE OF AVALANI AVENUE AT THE WESTERLY TERMINUS OF LUBY DRIVE

RECOMMENDATION

 

The Planning Commission voted 7-0-0 to recommend that the City Council adopt an ordinance to approve the subject rezoning. 

 

BACKGROUND

 

On October 10, 2001, the Planning Commission held a public hearing to consider a Planned Development  from R-M Multiple Residence to A (PD) Planned Development to allow five single-family courthome residential units. The project was considered as a consent item.

 

The Director of Planning, Building and Code Enforcement recommended approval of the proposed .

 

Planning staff noted that the General Development Plan text for the Planned Development Zoning Land Use Plan includes a landscape maintenance requirement, which stipulates that “a landscape maintenance district (or similar mechanism) shall be established to maintain front yard, courtyard area, and common area landscaping within the project.” Staff explained that a condition in the Planned Development Permit for the project would enact such a mechanism. A possible mechanism could be a requirement for the establishment of a Homeowner’s Association for maintenance of all common areas, including driveways/courtyards and landscaping. 

 

Chair Ross noted that he had requested that staff clarify this point so that the Planning Commission could be assured that this requirement would be adequately addressed in the Planned Development Zoning standards and in subsequent Planned Development Permits.

 

There was no further discussion by the Planning Commission.  Additionally, no one from the public spoke in opposition to or in support of the project.

 

The Planning Commission then closed the public hearing and reviewed and considered the Negative Declaration granted to the project.

 

PUBLIC OUTREACH

 

A notice of the public hearing was distributed to the owners and tenants of all properties located within 500 feet of the project site.

 

COORDINATION

 

As standard procedure in the development review process, this project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
