SUBJECT:  PDC03-069.  PLANNED DEVELOPMENT REZONING FROM CP - COMMERCIAL PEDESTRIAN TO A(PD) PLANNED DEVELOPMENT LOCATED ON THE SOUTHEAST CORNER OF MONTEREY HIGHWAY AND EDENVIEW DRIVE.

 

 

RECOMMENDATION

 

The Planning Commission voted 7-0 to recommend that the City Council approve the subject Planned Development Rezoning.

 

BACKGROUND

 

On November 19, 2003, the Planning Commission held a public hearing to consider a Planned Development  from CP - Commercial Pedestrian to A(PD) Planned Development to allow an existing approximately 2,200 square-foot retail building, and the construction of a new, approximately 3,922 square-foot retail building and associated improvements.

 

The Director of Planning, Building and Code Enforcement recommended approval of the proposed .  Mr. Penoeil Odisho, the project developer spoke in favor of the application.  Commissioner Zito asked staff for clarification on the proposed hours.  Staff indicated that as conditioned no additional commercial uses may operate between the hours of 12:00 midnight and 6:00 am.  No one else spoke in favor of or in opposition to the proposed rezoning.

 

The Planning Commission then closed the public hearing.

 

PUBLIC OUTREACH

 

A notice of the public hearing was distributed to the owners and tenants of all properties located within 500 feet of the project site.  Staff has been available to discuss the project with members of the public.

 

 

COORDINATION

 

As standard procedure in the development review process, this project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
