Approval of an agreement with Entravision Communications Corporation for the donation to the City of San José of two parcels of land and three nonexclusive one-year temporary construction easements on the west side of King Road between Barberry Lane and King Court.

BACKGROUND
The King Road Widening Phase III Project will add an additional lane to the southbound direction for a total of four lanes along King Road between Barberry Lane and King Court. The scope of work includes the construction of approximately 520 feet of sidewalk, curb and gutter, asphalt pavement, driveway, new street lighting, street trees, storm drainage, utility pole relocation, tree removal and striping.
The Entravision Communications Corporation property is located on the west side of King Road between Barberry Lane and King Court (map attached). The frontage of this property is needed for the implementation of the project. The property is unimproved, has no sidewalk, incomplete roadway improvements and limited street lighting.
The donated property is necessary to widen South King Road. The owner decided to donate the property rather than reimburse the City for the purchase at a later date under the requirements of the reimbursement ordinance. Two parcels in fee and three temporary construction easements (TCEs) are being donated:

All parcels are located on three Entravision properties located on the west side of King Road between Barberry Lane and King Court. The improvements extend approximately 520 feet along the west side of King Road fronting property owned by Entravision Communications Corporation. In order to complete the roadway widening, sidewalk construction and other improvements mentioned above, it is necessary to obtain approximately 7,699.9 square feet (0.18 acres) of right-of-way for the improvements and approximately 5,148.77 square feet (0.12 acres) for temporary construction easements. The TCEs are necessary for staging equipment and material during construction.
This project has been coordinated with the West Evergreen Neighborhood Advisory Committee.
The property and the temporary construction easements are being donated to the City. The only costs above staff time are approximately $3,500 for escrow and closing costs. These costs have been programmed in the Traffic CIP as part of the King Road/Barberry Lane project.
