To provide additional information after bids were opened.

 

 

RECOMMENDATION

 

Approval to reject all bids for the Plaza de Cesar Chavez Electrical Upgrades Project and authorization for the Director of Public Works to re-advertise and re-bid the project.

Prism Engineering, Inc. submitted a bid in the amount of $1,217,033 for the base bid.  On November 10, 2003, the contractor requested to be relieved of their bid due to allegedly having made a clerical error consisting of a mistake in their calculations. The contractor alleged that it inadvertently failed to include an amount of $400,000 for the construction of the East Vault.  The contractor provided documentation to support the alleged clerical error.  After reviewing the supporting documentation, staff has concluded that it is appropriate to relieve Prism of its bid based upon clerical error. 

 

The second low bid submitted by California Plus Engineering, Inc. in the amount of $1,360,000 for the base bid.  On November 21, 2003, the contractor also requested to be relieved of their bid due to having made an alleged clerical error consisting of a mathematical mistake in their estimating.  California Plus Engineering submitted documentation supporting the alleged clerical error.  After reviewing the supporting documentation, staff has concluded that it is appropriate to relieve the contractor from its bid based upon clerical error. 

 

The third bid submitted by ESR Construction was 33 percent above the Engineer’s Estimate and is considered excessively high.

 

Staff will evaluate the construction documents and determine the extent of the scope of work prior to re-bidding the project.
