RECOMMENDATION

 

Approval of an agreement with George P. Thotus and Ellen M. Thotus, trustees of the Thotus Living Trust dated 11/12/86, for the purchase of a parcel of land and a right of entry relating to property on the south side of Hillsdale Avenue between Narvaez Avenue and Canoas Creek in the amount of $12,800.  CEQA:  Exempt.

 

BACKGROUND

 

The Public Works Department is implementing an improvement project to widen and improve Hillsdale Avenue to its ultimate configuration between Narvaez and Canoas Creek. The project requires acquisition of a portion of the property owned by Mr. and Mrs. Thotus for the new street right of way.

 

ANALYSIS

 

The portion of land being purchased from Mr. and Mrs. Thotus is on the south side of Hillsdale Avenue between Narvaez and Canoas Creek and contains approximately 445 square feet.  The agreement for purchase provides the City with a right of entry to enter on the property prior to the close of escrow.  Also included is the purchase of a tree and relocation of mail boxes.

 

The City’s offer of $12,800 is based upon just compensation to the owner in the full amount of the independently contracted appraisal.

 

Upon Council approval, the City will be entitled to immediately enter upon the property to begin work on the project.  The escrow period is anticipated to close within ninety (90) days following Council approval.

COST IMPLICATIONS

 

The $12,800 cost of the acquisition is specified in the purchase agreement.  In addition, there will be escrow and closing costs estimated at $850.  The total cost is anticipated to be approximately $13,650.
