SUBJECT: Second Amendment to Legal Services Agreement with Shaw Pittman

Recommendation

Approval of a Second Amendment to the Legal Services Agreement with Shaw Pittman to increase the total compensation allowed under this agreement by $6,000 for a total not to exceed $206,000.00 to allow payment for additional services during the 2000-2001 term of the Agreement.

Analysis

The law firm of Shaw Pittman Potts and Trowbridge is a firm with a full-time aviation regulatory practice and provides a range of aviation-related legal services before the FAA and other administrative federal agencies in Washington, D.C. The firm is providing services necessary in conjunction with airport development and PFC financing issues before the FAA, international route bilateral negotiations and proceedings, and ongoing airport noise and environmental issues before the FAA. The provision of legal advice is coordinated through the City Attorney’s Office.

The addition of $6000 is necessary to pay for additional services requested in conjunction with litigation services and representation before the FAA on flight track issues.

The City Attorney's Office has entered into a new agreement with the firm for the FY 2001-2002, in the amount of $100,000.00, pursuant to Municipal Code § 4.04.030.

COORDINATION

This memorandum has been coordinated with the Airport Department and Risk Management.
