SUBJECT: PDC 99-07-066. PLANNED DEVELOPMENT REZONING LOCATED ON THE NORTH SIDE OF WEST ALMA AVENUE BETWEEN BELMONT WAY AND MINNESOTA AVENUE ON A 1.16 GROSS ACRE SITE.

The Planning Commission voted 6-0-1 (Zamora absent) to recommend that the City Council approve the proposed rezoning as proposed by the applicant.
BACKGROUND
On November 28, 2001, the Planning Commission held a public hearing to consider a Planned Development from CP Commercial Pedestrian to A(PD) Planned Development to allow an a mixed use development with up to fourteen multi-family attached residential units and up to 10,700 square feet of gross commercial area on a 1.16 gross acre site.
The Director of Planning, Building and Code Enforcement recommended approval of the proposed .
Staff stated that the development standards and staff report state that parking is not permitted in setback areas but that the General Development Plan provided by the applicant illustrates an encroachment into the setback area adjacent to Minnesota Ave. Staff clarified that the development standards supercede the General Development Plan and that staff will continue to work with the applicant to contain all of the parking on site outside of the setback area during the Planned Development Permit process stage.
The property owner, Chris Vlahopouliotis, and his architect, Sal Caruso spoke in support of the project. One member of the public spoke in support of the project.
The Planning Commission then closed the public hearing.
Commissioner Godbolt stated that the project will improve the area and she looks forward to the construction of the project.
Several community meetings for the project were held since its original filing, the most recent on September 10, 2001 at Galarza School. Attendees expressed concern regarding the height of the proposed buildings and neighborhood residents requested that the number of units be reduced.
A Negative Declaration and a notice of the public hearing before the Planning Commission and City Council were distributed to the owners and tenants of all properties located within 1,000 feet of the project site. Staff has been available to discuss the project with members of the public.
As standard procedure in the development review process, this project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
