REASON FOR SUPPLEMENTAL MEMO

 

To report on the bid results obtained after bids were opened on November 29, 2001.

 

RECOMMENDATION

 

Report on bids and award of contract for the Tuers-Capitol Golf Course Mitigation Project to the low bidder, Ecological Concerns Incorporated dba Central Coast Wilds, to include the base bid and Add Alternate No. 1 in an amount not to exceed $284,598.13, and approval of a contingency in the amount of $29,000.  CEQA:  EIR.

 

BACKGROUND

 

A memorandum dated November 26, 2001 was forwarded to the City Council for the December 18, 2001 Council meeting.  The purpose of this supplemental memorandum is to provide additional information obtained after the bid opening.

 

The items in the base bid scope of work include the development of four acres of riparian vegetation consisting of site clearing and preparation, the installation of an irrigation system, the planting of 1,500 native trees and shrubs and a 335 calendar day maintenance period.

 

In addition to the base bid scope of work, there was one Add Alternate bid item which includes the maintenance of 22 acres of grassland within the setback/buffer adjacent to the riparian corridor along the Coyote Creek for 335 calendar days.

The low bid submitted by Ecological Concerns, Inc., in the amount of $284,598.13, is 51 percent below the Engineer's Estimate.  A review of the individual bid items revealed that the contractor’s prices for many of the construction items were below the Engineer’s Estimate. The low bid contractor specializes exclusively in native plant propagation and native habitat construction.  The low bid price reflects this area of focus and familiarity with such installations.  Staff has discussed the low bid with Ecological Concerns, Inc., who has indicated that he interpreted the plans correctly and can successfully complete the work within the bid amount.  There are no clerical errors.

 

The Engineer’s Estimate was developed from a standard landscape installation perspective.  The bidding process was open to general landscape contractors.  The variance in the bid results is indicative of that broader perspective.  The low bid is consistent with the specific focus of a particular contractor extremely familiar with native habitat installations, that is the objective of the proposed project.

 

Staff recommends awarding a contract to the low bidder.

 

A contingency reserve budget in the amount of $29,000 is requested for any unforeseen conditions that may arise during construction of this project.

 

PUBLIC OUTREACH

 

This proposed project was listed on the City’s Internet bid line and advertised in the San José Mercury News and San José Post Record.  Bid packages for all Department of Public Works construction projects are routinely provided to a standard list of various contractor organizations, builder’s exchanges and disadvantaged business organizations, including United Minority Business Enterprises and the San José Minority Business Development Center.

 

COORDINATION

 

This proposed project was coordinated with the City Manager’s Budget Office; Offices of the City Attorney, Risk Manager and Equality Assurance; and the Departments of Planning, Building and Code Enforcement; Conventions, Arts and Entertainment; Environmental Services; General Services, and Parks, Recreation, and Neighborhood Services.
