FUNDING SOURCES RESOLUTION AMENDMENTS IN THE COUNCIL DISTRICT 7 CONSTRUCTION
AND CONVEYANCE TAX FUND AND THE PARK TRUST FUND FOR THE SOUTH CENTRAL SWIM
CENTER PROJECT.

It is recommended that the City Council take the following actions:
1.
Report on
bids and award of contract for South Central Swim Center Project to the low
bidder, West Bay Builders, Inc., to
include the base bid and Add Alternate Nos. 1, 2,
and 3 in the amount of $4,649,800, and
approval of a contingency in the amount of
$465,000. CEQA: Negative
Declaration.
2. Adoption of the following Appropriation
Ordinance amendments.

1. Increase the South Central Swim Center project
by $170,000
2. Decrease
the Ending Fund Balance by $170,000

2. Decrease the Reserve: Future PDO/PIFO Projects by $700,000
BACKGROUND
The South Central Swim Center site is located in central San José near the intersection of McLaughlin Avenue and Bacchus Drive (map attached). The City-owned site is approximately 3.5 acres of undeveloped former-agricultural land. The site is bordered on the north by apartment housing on Darwin Court, on the south by single family houses on Holly Hill Drive, and to the east by Highway 101. Santee Elementary School and Fair Middle School are located nearby.
The site is located in the Santee neighborhood at the east end of Bacchus Drive and was originally acquired by the City for an overpass for Highway 101 to connect Phelan Drive to Ocala Drive. During the 1995 General Plan Annual Review, the City Council approved the deletion of the Phelan/Ocala overcrossing of Highway 101 from the San José 2020 General Plan. The action made the 3.5 acre site “surplus land.” The General Plan recommended the development of a neighborhood park on the City-owned property with a swimming pool as a main focus of the park.
The Santee Neighborhood Revitalization Plan approved by City Council in 1996 recommended that the design of the park also include appropriate recreation amenities such as play equipment, picnic areas, benches, etc.
In 1999, the Council District 7 office initiated the planning of the site to include amenities as outlined in the Santee Neighborhood Revitalization Plan. The process to master plan the site included community meetings to gather input and to review and approve design options as they were developed. Through that community process, a final design was developed and approved by vote of those in attendance. The South Central Swimming Pool Master Plan is the product of that planning effort, which involved the cooperation of the Council Office, community members, and City staff. The master plan was approved by the City Council on February 6, 2001.
This project will build out the entire swimming pool complex in accordance with the master plan. Staff anticipates that the swim facility will open for use in the fall of 2002. Naming of the facility is expected to take place prior to the completion of construction.
The base bid scope of work for this project will include installation of children, family and lap pools, a pool house with offices, restrooms/lockers, classroom, food service area, and first aid station, a pool mechanical and storage building, parking lots, lighting, fencing, irrigation, and planting improvements.
In addition to the base bid there are four Add Alternate bid items as follows:

The low bid, submitted by West Bay Builders, Inc., in the amount of $4,649,800 for the base bid and Add Alternate Nos. 1, 2, and 3 is 9 percent over the Engineer's Estimate. The bid is considered reasonable for the work involved in the proposed project.
A contingency in the amount of $465,000 is requested for any unforeseen conditions that may arise during construction of this proposed project.
An additional $870,000 is needed to complete the project. The funding will be necessary for the difference in the Contractor’s and the Engineer’s Estimate for the base bid, award of Add Alternate Nos. 1, 2, and 3, utility installation costs, and the associated increased contingency and construction inspection.
It is recommended that the additional funding be provided from the Council District 7 Construction and Conveyance Tax Fund ($170,000) and the Park Trust Fund ($700,000). The Park Trust Fund supplement is intended as a temporary commitment of funds to complete the project. The anticipated $700,000 of Parkland Dedication Ordinance Fees from development of the Children’s Shelter site on Roberts Avenue will be allocated to the Swim Center once they are received.
This proposed project was listed on the City’s Internet bid line and advertised in the San José Mercury News and San José Post Record. Bid packages for all Department of Public Works construction projects are routinely provided to a standard list of various contractor organizations, builder’s exchanges and disadvantaged business organizations, including United Minority Business Enterprises and the San José Minority Business Development Center.
This project was coordinated with the Offices of the Risk Manager, City Attorney, City Manager and Equality Assurance; and the Departments of Parks, Recreation and Neighborhood Services, Planning, Building and Code Enforcement, Transportation, Fire, Police and General Services.
