Subject: CONTINUATION AGREEMENT FOR AMPHION
ENVIRONMENTAL, INC. AND ASSOCIATED APPROPRIATION ACTIONS

It is recommended that the City Council take the following actions:
1. Approval of a continuation agreement with Amphion Environmental, Inc. for consultant services for Various Park and Recreation Projects, extending the term of the master agreement from October 28, 2001 to December 31, 2002.
2. Adoption of an Appropriation Ordinance amendments in the Citywide Construction and Conveyance Tax Fund:
a. Increase the Bay Trail Planning/EIR project in the amount $18,000,
b. Decrease the Ending Fund Balance by $18,000.
BACKGROUND
On October 27, 1998, the City Council approved a master agreement with Amphion Environmental, Inc. for design services, and various park and recreation projects for a maximum compensation in the amount of $160,000 and a term from October 27, 1998 to October 27, 2000. Under this master agreement, the consultant has worked on two projects, the Bay Trail Master Plan and Coyote Creek Trail at Yerba Buena.
Under the terms of the master agreement, the Director of Public Works was authorized to approve a one-time extension of the term up to six months. On August 16, 2000, the Director issued a letter for a six-month extension to extend the master agreement term from October 27, 2000, to April 27, 2001.
On November 14, 2000, the first amendment to the master agreement was approved by the City Council to increase the additional service fees by $40,000 with the master agreement maximum compensation not to exceed $200,000. The additional funding allowed the consultant to perform additional design and construction support services for the Bay Trail Master Plan and Coyote Creek Trail at Yerba Buena.
On April 10, 2001, the City Council approved the second amendment to the master agreement to extend the term from April 27, 2001 to October 27, 2001.
ANALYSIS
Staff proposes to continue the term of this master agreement from October 28, 2001 to December 31, 2002. This extension will allow staff to engage the services of this consultant to provide further coordination with private developers and agencies regarding revisions to the proposed Bay Trail alignment, and to modify the Bay Trail Master Plan report and preliminary cost estimates. Proposed private developments, unanticipated meetings, and unanticipated environmental requirements have increased the amount of coordination time and funds needed to finalize the master plan.
While no overall increase in the master agreement is required, the amount of funding provided by the Bay Trail Project to support the agreement needs to be increased by $18,000 based on the amount of work associated with this project. Savings generated by the Coyote Creek Trail Project portion of the master agreement will provide funding (in the form of fund balance) to cover the higher cost of the Bay Trail Project. The recommended appropriation action reflects the technical adjustment to accommodate this change.
