EASTERLY SIDE OF MONTEREY HIGHWAY, APPROXIMATELY 100 FEET SOUTHERLY OF BLOSSOM
HILL ROAD (5502 MONTEREY HIGHWAY)

The Planning Commission voted 7-0 to recommend that the City Council approve the rezoning.
BACKGROUND
On March 26, 2003, the Planning Commission held a public hearing to consider a Rezoning from A(PD) Planned Development to A(PD) Planned Development to allow an approximately 5,150 square-foot stockroom expansion to an existing retail building on a 9.15 gross acre site.
Staff noted in a brief oral presentation that an electronic communication had been submitted regarding the proposed rezoning by John Cadet, a resident of the neighborhood immediately adjacent to the rear of the existing facility (see attached). Staff indicated that the communication raised concerns regarding unpermitted lighting and storage containers and recycling activities that were existing at the rear of the commercial facility. Mr. Cadet also stated that construction staging should not be allowed adjacent to the residential neighborhood. Staff assured the Commission that follow-up would occur regarding the lighting issue to ensure conformance with the previously approved plans. Staff further indicated that the proposed stockroom addition was intended to replace the unpermitted storage containers and that staff would work with the applicant and the neighborhood at the Planned Development Permit stage to appropriately limit areas of construction staging and to address concerns regarding uses and activities immediately adjacent to the single-family neighborhood.
The Director of Planning, Building and Code Enforcement recommended approval of the proposed . The project was considered as a consent calendar item. No one from the public spoke in favor of or in opposition to the project.
The Planning Commission then closed the public hearing.
A notice of the public hearing was distributed to the owners and tenants of all properties located within 1,000 feet of the project site.
The Director of Planning has determined that this project is exempt from further environmental review under the provisions of the California Environmental Quality Act (CEQA). CEQA Guidelines include an exemption (Section 15301(e)(2)) for projects that consist of minor additions or modifications to existing structures.
This project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
