Subject:  PENITENCIA CREEK REACH 2 PHASE 1 DEVELOPMENT

RECOMMENDATION

 

Approval of an agreement with Amphion Environmental, Inc. for design services for the Penitencia Creek Reach 2 Phase 1 Development, for a base fee in the amount of $118,300, and additional services in the amount of $20,000 for a total agreement amount of $138,300, from the date of execution to December 31, 2005.

BACKGROUND

 

The area designated for the Penitencia Creek Reach 2 Project is approximately 26 acres of undeveloped park lands.  It is surrounded on the east and west by single family residences, on the north by Noble Avenue, and on the south by Penitencia Road (map attached).  The park site is made up of several adjacent parcels of land owned by Santa Clara County (SCC), Santa Clara Valley Water District (SCVWD), the City of San José and the Berryessa Union School District.  The site is generally flat and bare, containing three percolation ponds, a small grove of walnut trees and the tree-lined Penitencia Creek along the south side of the site adjacent to Penitencia Road.

 

The master plan for this project, prepared by Amphion Environmental Inc., was approved by the Parks and Recreation Commission on May 1, 2002 and by Council on June 4, 2002.  The master plan includes the following amenities: park trails and bridges over spillways, a regional trail connection along Penitencia Creek, individual family picnic areas, a group picnic area, irrigated turf area, fishing/model boat launching pier, a parking lot and a restroom.

 

The implementation of the Penitencia Creek Park Reach 2 Master Plan will take place in phases.  The first phase will incorporate the following design components:  an asphalt trail extending from the main park entry and connecting to an existing path at the western edge of the park; two bridges; family picnic area; planting and irrigation and miscellaneous site amenities.

 

An alternative to hiring a consultant for this work is for the work to be done by existing City staff.  Staff considered this alternative and recommends using a consultant because current City staff is fully utilized for coordination and plan review services and there are no available existing City staff resources with appropriate design and master plan expertise.  Shifting existing City staff resources to this project at this time would delay the project.

 

The start date of the agreement is May with completion in December 2005.

 

 

ANALYSIS

 

The Department of Public Works maintains an active list of pre-qualified consultants for design services for public parks, recreation and revenue generating facilities. The recommended firm, Amphion Environmental Inc. of Oakland, California, is on the current list.

 

Amphion Environmental Inc. has project management and design experience for complex trail projects and other landscape architectural projects.  Amphion Environmental Inc. provides expertise, either as the prime consultant or through subconsultants, that includes architectural design, landscape architecture/recreation planning, environmental planning, and cost estimating. 

 

The agreement scope of services includes but is not limited to:  the preparation of preliminary design and construction documents and the provision of construction administration for the project.  The total cost for this project is anticipated to be $1,192,000.

 

This agreement contains a clause for additional services to provide for typically encountered, but not presently identifiable services to include extended coordination with permitting agencies, possible additional site survey due to recent topographic alterations by the Santa Clara Valley Water District and expanded construction assistance to address unanticipated issues.  Authorizing additional services via the agreement is both cost and time effective.

 

 

PUBLIC OUTREACH

 

The Department of Public Works established a list of consultants according to the Department’s formal (over $250,000) selection policy for retaining consultants. The process included public advertisement for a Request for Qualifications which ran in the San José Mercury News, the City’s Internet Bid Line, and professional trade newsletters.

 

 

COORDINATION

 

This agreement and memo have been coordinated with the City Attorney’s Office, the City Manager’s Budget Office, and the Departments of Finance, Parks, Recreation and Neighborhood Services and Planning, Building and Code Enforcement.

4.         OPERATING COSTS:  This project is consistent with the Council-approved Budget Strategy General Principles and Economic Recovery sections in that it will stimulate local economic growth and recovery.  The project will have a neutral impact on the General Fund.  The estimated operating and maintenance costs associated with this development is $7,000 annually.
