SUBJECT:     ADOPTION OF A RESOLUTION TO ACCEPT THE OFFICE OF TRAFFIC SAFETY 2003-05 DUI GRANT AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE GRANT AGREEMENT, AND RELATED APPROPRIATION ACTIONS FOR FISCAL YEAR 2002-03

RECOMMENDATION

 

1.      It is recommended that the City Council adopt a resolution to accept the State of California, Office of Traffic Safety (OTS) 2003-05 DUI grant in the amount of $154,000 and authorize the City Manager to execute the related grant agreement.

 

2.      It is also recommended that the City Council adopt the following amendments to the annual appropriation ordinance and the annual funding sources resolution in the General Fund (Fund 001) for fiscal year 2002-03:

 

a)      Establish an OTS 2003-05 DUI grant appropriation for the Police Department in the amount of $45,194;

 

b)      Increase Revenue from the State by $45,194.

 

 

BACKGROUND

 

The State of California, Office of Traffic Safety (OTS) has established a new grant program designed to reduce alcohol-involved collisions.  San Jose is one of 18 cities selected statewide to participate in this unique DUI grant outreach program.  Through this new DUI grant program, OTS is offering funding to implement “best practice” strategies that focus on enforcement, prevention, education and awareness.  There is no grant match required.

In order for the Police Department to start using these funds, acceptance of the grant, execution of the grant agreement, and a related appropriation of funds are required.

 

 

ANALYSIS

 

The San Jose Police Department’s main goal for the OTS grant is to reduce the number of victims killed or injured as a result of DUI (Driving Under the Influence) drivers.  With the use of OTS grant funds, Police will be conducting sobriety checkpoints, presentations at local high schools, saturation patrols, educational campaigns, focused enforcement on habitual DUI offenders, and training sessions for enforcement personnel.  In addition, the Department will use local media to increase community awareness of DUI problems.

 

The OTS DUI grant in the amount of $154,000 is for the period of May 1, 2003 through April 30, 2005.  Grant funds will be disbursed to the City on a reimbursement basis.  The grant will primarily fund overtime for Officers to staff DUI check-points and to provide educational programs.  The grant will also fund the purchase of a changeable message sign, preliminary alcohol screening (PAS) devices, evidentiary PAS devices, promotional and educational materials, and training. 

 

For fiscal year 2002-03, the appropriation amount of $45,194 includes the following items:

The remaining $108,806 of the $154,000 grant will be addressed as part of the FY03-04 and FY04-05 budget processes.

 

 

PUBLIC OUTREACH

 

Not applicable.  The City of San Jose was selected to participate in this new OTS program.  

 

 

COORDINATION

 

This memorandum has been coordinated with the City Manager’s Office, the Manager’s Budget Office, and the Office of the City Attorney.

COST IMPLICATIONS

 

There are no matching fund requirements for this grant.  Minor in-kind contributions for staff involved in the administration and support of this grant will be absorbed by the Police Department.   There may be future maintenance costs related to the message sign and the PAS (Preliminary Alcohol Screening) devices.  These future costs will be addressed within the Police Department’s non-personal budget.  There are no ongoing cost implications for the remaining items on the proposed grant.

 

This Council agenda item is in line with the General Principles of the Mayor’s Budget Strategy in that special grant funds are being utilized to provide more efficient and cost-effective delivery of Police services.
