RECOMMENDATION

 

1.      Report on bids and award of contract for the Buena Vista Park Project to the lowest responsive bidder, Beacon Construction, Inc., in the amount of $179,884, and approval of a contingency in the amount of $9,000. 

 

2.      Adopt the following Appropriation Ordinance amendments in the Council District 6 Construction and Conveyance Tax Fund:

 

a)   Increase the appropriation for the Buena Vista Park Development Project (Appn 4469) by $93,000, from $162,000 to $255,000;

b)   Decrease the Ending Fund Balance by $93,000.

 

 

BACKGROUND

 

Buena Vista Park is located at the intersection of Scott and Menker Streets (map attached).   Single family homes border the site to the north and east; residential streets are to the south and west.

 

The site is the former location of the 498 Menker Street residence - a single family home purchased by the City which was demolished to provide public park space.

 

This project will construct the proposed new park, which will include a youth and tot lot, open lawn space, picnic areas and seating.

 

Construction is scheduled to begin in June with completion in October.

The low bid, submitted by Colony Landscape, Inc., did not include a signed Addendum No. 1 and accordingly, is considered non-responsive.  The lowest responsive bid submitted by Beacon Construction, Inc. is four percent below the Engineer's Estimate.  The lowest responsive bid is considered acceptable for the work involved.

 

The additional funds associated with the recommended appropriation ordinance amendment represent the difference between funds appropriated for the project and funds needed for the construction contract management and contingency.  These funds were being provided by the San José Redevelopment Agency through the Strong Neighborhoods Initiative (SNI) from the Burbank SNI area.  Since the SNI funds are in jeopardy at this time, staff recommends the use of the Council District 6 C&C funding in order for this project to be completed without delay.

 

Council Policy provides for a standard contingency of five percent on public works park projects.  The standard contingency is appropriate for this project.

 

 

PUBLIC OUTREACH

 

To solicit contractors, this project was listed on the City’s Internet Bid Line and advertised in the San José Mercury News and San José Post Record.  Bid packages for all Department of Public Works construction projects are provided to various contractor organizations and builder’s exchanges.

 

 

COORDINATION

 

This project and memo were coordinated with the City Attorney’s Office and the Departments of Finance, Planning, Building and Code Enforcement, General Services and Parks, Recreation and Neighborhood Services.

4.      OPERATING COSTS:  The adopted Capital Improvement Program for FY03-07 projects the following annual operating impacts: $15,000 in FY03-04, $16,000 in FY04-05, $17,000 in FY05-06, and 17,000 in FY06-07.  This project is consistent with the Council-approved Budget Strategy’s Economic Recovery section in that it will spur construction spending in our local economy.
