Approve the following actions to provide pavement maintenance along Capitol Avenue:
1. Adopt a resolution authorizing the City Manager to negotiate and execute cooperation agreements with the Santa Clara Valley Transportation Authority in an amount not to exceed $700,000.
2. Adopt the following Appropriation Ordinance amendments in the Construction Excise Tax Fund:
a. Increase the appropriation to the Department of Transportation for the "Street Maintenance: TCRP project" by $700,000.
b. Reduce the Reserve for TCRP- Street Maintenance by $700,000.
BACKGROUND
As part of the 1996 Measure A+B Transportation Improvement Program, the Santa Clara Valley Transportation Authority (VTA) is constructing the Tasman East and Capitol Light Rail Transit (LRT) projects. Within the limits of the City of San José, the Tasman East and Capitol LRT projects span the entire five-mile length of Capitol Avenue from the Milpitas border to Capitol Expressway. Full service operation for the Tasman East and Capitol LRT projects is currently scheduled to begin in mid-2004 and will provide direct light rail service between the residential neighborhoods in East San José and Berryessa to job centers in North San José, as well as Milpitas, Santa Clara, Sunnyvale and Mountain View.
In anticipation of the construction of the LRT projects, the City has deferred pavement maintenance along Capitol Avenue for over a decade. Further, the condition of the pavement has been impacted by the LRT project construction due to the extensive underground utility work and heavy equipment operating on the roadway.
To address the pavement condition along Capitol Avenue, it
is proposed that the City and VTA jointly fund the costs to improve and
resurface the entire roadway, and to have the VTA implement the construction to
coincide with the completion of the LRT projects. Under this arrangement the City would contribute to the cost for
pavement maintenance activities outside of the areas directly impacted by the
LRT construction.
In March 2001, the City and VTA entered into an agreement for the joint funding of improvements with the Capitol LRT project in the amount of $795,000, of which approximately $500,000 was for City pavement maintenance. The recommended new agreements would add $700,000 in City funding to address pavement maintenance needs along Capitol Avenue as part of the Tasman East LRT project and to supplement the original Capitol LRT project agreement.
The total cost of pavement maintenance needs along Capitol Avenue is approximately $5.5 million. The VTA is funding $4.3 million (78%) due to the impacts of the LRT project. The City’s funding share of $1.2 million (22%), allows for addressing the balance of pavement maintenance needs along the entire five-mile corridor. It is noted that for pavement maintenance work outside the direct LRT project construction limits, it is proposed the VTA contribute 15% of the pavement maintenance cost to account for accelerated roadway deterioration created by heavy construction vehicle traffic in the Capitol Avenue corridor.
In addition to the cost effectiveness benefit, other advantages to consolidating VTA and City pavement maintenance work on Capitol Avenue include:
· Reducing construction impacts to the adjacent communities and businesses by providing for a one-time construction activity.
· Improving the quality of the roadway reconstruction by constructing the roadway improvements in a single, coordinated effort.
· Completion of the entire roadway will contribute to improving the aesthetics of Capitol Avenue.
· Addresses ongoing maintenance concerns and citizen complaints with respect to the poor quality of the roadway.
The VTA has scheduled the roadway resurfacing construction activities along Capitol Avenue to coincide with the more favorable weather conditions of mid-spring through late fall of this year, and is prepared to award a contract to perform this work on May 1, 2003 along the Tasman East LRT corridor. It has been requested that the City provide the VTA with the funding necessary to complete the roadway reconstruction prior to the VTA's contract award date. This would ensure that the VTA does not have to advance its own funds to complete this work.
The recommendations in this report consist of authorizing the City Manager to negotiate and execute the following two cooperation agreements with the VTA, in a total combined amount not to exceed $700,000:
1.
For the Tasman East
LRT Corridor (Milpitas to Hostetter), the City would pay VTA approximately
$400,000 for pavement maintenance in the areas beyond the limits of the LRT
construction.
2. For the Capitol LRT Corridor (Hostetter to Capitol Expressway), the March 2001 agreement with the VTA would be amended to add approximately $300,000 in City funding for pavement maintenance in the areas beyond the limits of the LRT construction. Subsequent to the March 2001 agreement and since the start of LRT construction, additional pavement maintenance needs have been identified, that were triggered by construction activities.
The specific cost sharing amounts and agreement language is being negotiated with the VTA. The VTA has requested the City's endorsement of the agreement as soon as possible so as to allow them to award the first paving contract. The pavement work is scheduled to be complete in late 2003.
The City's Traffic Capital Budget is the recommended source of funding for the $700,000 needed to complete pavement maintenance work along Capitol Avenue. City street maintenance funding for Capitol Avenue had been earmarked for expenditure in FY 2003-04, using anticipated revenues from the State’s Traffic Congestion Relief Program (TCRP), from which the City had expected to receive $2 million annually.
In FY 2002-03 the City received a first quarter payment of State TCRP revenues in the amount of $513,000 for street maintenance. Due to proposed State budget cuts, the City did not expect to receive additional TCRP funds and, on February 11, 2003, during the Mid-Year Budget Review process, the Council approved placing the balance of the TRCP street maintenance appropriation into a reserve in the amount of $1,487,000.
Subsequently, the City unexpectedly received a second quarter payment of State TCRP funds in the amount of $712,000. Since the State legislature has not yet acted on proposed budget cuts to the TCRP program, existing legislation mandates the continued payment of the TRCP street maintenance funding to local agencies. It is now recommended that $700,000 from the newly received TCRP funds be reallocated from the TCRP reserve and into the TCRP Street Maintenance appropriation for use on Capitol Avenue.
This item has been coordinated with the Santa Clara Valley Transportation Authority. In addition, the LRT projects on Capitol Avenue have been discussed with the public at several community meetings and open house events within the respective project areas.
