SUBJECT:  PDC03-002.  PLANNED DEVELOPMENT REZONING FROM LI - LIGHT INDUSTRIAL TO A (PD) PLANNED DEVELOPMENT LOCATED ON THE EASTERLY SIDE OF MONTEREY HIGHWAY, APPROXIMATELY 950 FEET NOTHERLY OF BLOSSOM HILL ROAD ( 5350 MONTEREY HIGHWAY)

RECOMMENDATION

 

The Planning Commission voted 7-0 to recommend that the City Council approve the subject Planned Development Rezoning.

 

BACKGROUND

On April 23, 2003, the Planning Commission held a public hearing to consider a Planned Development  from LI – Light Industrial to A (PD) Planned Development to allow up to 15 attached, affordable residential units for developmentally disabled adults.

 

The Director of Planning, Building and Code Enforcement recommended approval of the proposed .  Commissioner Levy expressed concerns regarding the proposed reduced parking ratio and asked staff to confirm that the project is limited to developmentally disabled adults.  Staff indicated that a rezoning would be required to convert the project to unrestricted units, at which time, the parking ratio would be reexamined if the type of tenants changed in the future.

 

Commissioner Zito asked for clarification regarding the status of the cleanup of any hazardous materials from the abandoned gasoline service station on the site.  John Schwarz, the environmental consultant for the project developer, indicated that leaking underground tanks from the old gasoline service station had been removed and remedial action undertaken per the standards of the Santa Clara Valley Water District (SCVWD).  As noted in the attached letter from David J. Powers & Associates, the cleanup was completed and the case was closed in 1995.

 

No one else spoke in favor of or in opposition to the proposed project.

 

The Planning Commission then closed the public hearing.

 

PUBLIC OUTREACH

 

A notice of the public hearing was distributed to the owners and tenants of all properties located within 500 feet of the project site.

 

COORDINATION

 

As standard procedure in the development review process, this project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
