SUBJECT: THIRD AMENDMENT TO THE MASTER AGREEMENT WITH BEALS ALLIANCE, INC. FOR VARIOUS PARK AND RECREATION PROJECTS.

Approval of the third amendment to the agreement with Beals Alliance, Inc. for consultant services for various park and recreation projects, extending the agreement term from June 5, 2001 to December 31, 2004 and increasing compensation by $200,000, from $800,000 to $1,000,000.
BACKGROUND
In June 2001, the City entered into a master agreement with Beals Alliance, Inc. for design services for various park and recreation projects. To date, 12 projects have been authorized under this master agreement.
Most recently, the master agreement was used so that Beals Alliance, Inc. could begin the design and construction documents for the development of Selma Olinder Park. The Selma Olinder Park Master Plan was approved by Council in September 2001. The build-out of the park master plan is divided into two phases based on available funding for the project in Fiscal Year 2002-03 and projected funding in Fiscal Year 2003-04. The remaining funds in the master agreement provided for 95 percent of Phase I and 50 percent of Phase II construction documents.
This third amendment will provide sufficient funds to cover the fees needed for Beals Alliance, Inc. to complete the remaining work on Phases I and II construction documents for the development of Selma Olinder Park. In addition to the construction documents, their work includes preparation of cost estimates, assistance during bid and construction and coordination with the Santa Clara Valley Water District and other agencies. The term of the agreement is being extended to match the adopted project schedule.
Beals Alliance, Inc. was the landscape architectural consultant that provided design services for the Selma Olinder Park Master Plan. Due to their familiarity with the park master plan and the urgency for completion of the construction documents, the firm has been retained using the existing master agreement to provide construction documents for the build-out of the master plan.
An alternative to extending this agreement for consultant services is for the work to be done by existing City staff. Staff considered this alternative and recommends continuing this agreement with Beals Alliance because current City staff is fully utilized for coordination and plan review services and there are no available existing City staff resources with appropriate expertise. Shifting existing City staff resources to these projects at this time would delay these various projects.
Staff recommends increasing the agreement amount from $800,000 to $1,000,000 and extending the agreement through December 31, 2004 so that work for the Selma Olinder Park development project may continue without delay.

Departments of Parks, Recreation and Neighborhood Services, Finance and
Planning, Building and Code Enforcement, the City Attorney’s Office and the
City Manager’s Budget Office.
