SERVICES AGREEMENT WITH BEVILACQUA-KNIGHT INC.

Approval of a First Amendment to the Managers Consultant Service Agreement between the City of San Jose and the firm of Bevilacqua-Knight Inc. The Agreement is for the Preparation of Studies, Analyses and Tasks to assist the Airport with complying with the Airport Master Plan Mitigation and the California Air Resources Board certification of the Master Plan. The approval will increase the maximum cost of the agreement by $50,000 (from $50,000 to $100,000) and extending the term of the agreement to June 30, 2002.
BACKGROUND
The City of San Jose International Airport Master Plan Update requires certification from the California Air Resources Board that all projects in the plan will be located, designed, constructed and operated in compliance with applicable air and water quality standards. Based on these requirements the Airport is implementing measures to mitigate these impacts. Accordingly the City of San Jose committed to a mitigation program in its Master Plan Update.
To reach these goals the Airport has embarked on an Alternative Fuel program which includes the design of a compressed natural gas fueling facility, as well as the purchase of compressed natural gas buses.
Bevilacqua-Knight Inc. has provided valuable consultant services, which have included technical and feasibility analyses of the operational, cost and air quality factors associated with various alternative fuels. The original agreement term was from May 15, 2000 to June 30, 2001 with a total compensation of $50,000. Due to the vast scope of this program, which contains both complex technical, regulatory and administrative issues, the level of consultant assistance required to adequately complete the program is needed at the current level into fiscal year 2001/2002. The addition of $50,000 to the consultant agreement (for a total not-to-exceed maximum cost of $100,000) and an extension of the agreement from July 1, 2001 to June 30, 2002 will provide a sufficient budget and term to the alternative fuel program implementation.

AIRPORT MASTER PLAN CONSISTENCY
The San Jose Municipal Code requires all Airport capital projects to be consistent with the adopted Airport Master Plan. Completion of the alternative fuel program implementation supports the Airport Master Plan Mitigation Measures by ensuring that mandated California Air Resources Board standards are met, and is therefore consistent with the Airport Master Plan pursuant to Section 25.04.21(B)(2) of the Municipal Code.
Preparation of this proposed amended Managers Services Consultant Agreement has been coordinated with the City Attorney's Office.
