RECOMMENDATION

 

Report on bids and award of contract for the Payne Avenue Sidewalk – Eden Ave to Winchester Blvd Project to the low bidder, OC Jones and Sons Incorporated, in the amount of $162,984, and approval of a contingency in the amount of $25,000.

 

 

BACKGROUND

 

A portion of the north side of Payne Avenue from Eden Avenue to approximately 450 feet east is unimproved (map attached).  It is inconvenient, especially during the winter season, for pedestrians and bicyclists to travel in this area without any sidewalk, curb and gutter and streetlights.

 

The Payne Avenue Sidewalk – Eden Ave to Winchester Blvd Project will provide continuity for pedestrian travel on Payne Avenue by constructing sidewalk, curb, gutter and concrete driveways.  This project also includes the installation of street lights and a drainage lateral and inlet.

 

In response to community input, this project design incorporates “traffic calming” elements at the intersection of Payne and Eden Avenues.  They include the construction of embossed pedestrian crosswalks to emphasize the crosswalk area for pedestrian crossing and the construction of bulb outs at the two north corners of the intersection to reduce traffic speed.  

In addition, shrubs will be planted in the bulb outs.

 

 

The City applied for and received a Transportation Development Act (TDA) Grant from the Metropolitan Transportation Commission for several projects.  The Payne Avenue Sidewalk Project is one that will be constructed with TDA funds.

 

Construction is scheduled to begin in September with completion in November.

The low bid submitted by OC Jones and Sons, Incorporated is 10 percent above the Engineer’s Estimate.  Staff considers this reasonable for the work involved.

 

Council Policy provides for a standard contingency of five percent on public works projects involving street and sidewalk.  However, on this project a contingency of 15 percent is being requested because a similar project in the area encountered underground conflicts that resulted in significant change orders.  The funds budgeted for this project are sufficient to provide for the recommended contingency.

 

 

PUBLIC OUTREACH

 

Staff from the Departments of Public Works and Transportation met with residents at the project area to inform them of the proposed improvements and to solicit their comments.  The project design incorporates some of their input regarding the locations of streetlights, driveways, and sidewalks.

 

To solicit contractors, this project was listed on the City’s Internet Bid Line and advertised in the San José Mercury News and the San José Post Record.  Bid packages for all Department of Public Works construction projects are provided to various contract organizations and builder’s exchanges.

 

 

COORDINATION

 

This project and memo were coordinated with the City Attorney’s Office, the City Manager’s Budget Office and the Departments of Planning, Building and Code Enforcement Finance, and Transportation.

3.     SOURCE OF FUNDING:  465 – Construction Excise Tax Fund

 

4.     FISCAL IMPACT:  This project is consistent with the Council-approved Budget Strategy Economic Recovery section in that it will spur construction spending in our local economy.  The proposed operating and maintenance costs of this project have been reviewed and it has been determined that the project will have no significant adverse impact on the General Fund operating budget.
